  1.1                          A bill for an act 
  1.2             relating to public safety; providing that a person 
  1.3             carrying a firearm must obtain express permission 
  1.4             before entering a building; authorizing governmental 
  1.5             subdivisions to make and enforce relevant policies; 
  1.6             providing criminal penalties; amending Minnesota 
  1.7             Statutes 2002, section 624.714, by adding a 
  1.8             subdivision; repealing Minnesota Statutes, section 
  1.9             624.714, subdivisions 17 and 23, as added by Laws 
  1.10            2003, chapter 28, article 2, sections 22 and 28. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  Minnesota Statutes 2002, section 624.714, is 
  1.13  amended by adding a subdivision to read: 
  1.14     Subd. 18a. [TRESPASS; PERMIT HOLDER MUST OBTAIN PERMISSION 
  1.15  TO ENTER PROPERTY.] (a) A person carrying a firearm on or about 
  1.16  the person's clothes or person under the authority of a permit 
  1.17  issued under this section or recognized under subdivision 16 
  1.18  must not enter any public or private building, including a 
  1.19  residence, without the express consent of the lawful possessor 
  1.20  or a person authorized to give consent.  A person who violates 
  1.21  this paragraph is guilty of a misdemeanor. 
  1.22     (b) Notwithstanding section 471.633 and 624.717, a city, 
  1.23  county, town, municipal corporation, other governmental 
  1.24  subdivision, or any of their instrumentalities may develop and 
  1.25  enforce policies to grant or deny access to buildings owned, 
  1.26  leased, or operated by the entity as provided under paragraph 
  1.27  (a). 
  1.28     (c) This subdivision does not apply to activities that are 
  2.1   authorized under subdivision 9.  This subdivision does not apply 
  2.2   to licensed peace officers. 
  2.3      [EFFECTIVE DATE.] This section is effective May 28, 2003, 
  2.4   and applies to crimes committed on or after that date. 
  2.5      Sec. 2.  [REPEALER.] 
  2.6      Minnesota Statutes, section 624.714, subdivisions 17 and 
  2.7   23, as added by laws 2003, chapter 28, article 2, sections 22 
  2.8   and 28, are repealed. 
  2.9      [EFFECTIVE DATE.] This section is effective May 28, 2003.
