Relating to telecommunications; promoting competition within the local exchange
marketplace; requiring the public utilities commission to order structural
separation of retail and wholesale operations of large incumbent local exchange
carriers into affiliated companies upon a finding of anticompetitive or
discriminatory conduct of an incumbent local exchange carrier, requiring the
retail affiliate to operate as a competitive local exchange carrier or as a
telephone company and the wholesale affiliate to own and operate network
facilities; specifying certain requirements for transactions and agreements
between the affiliates, requiring separate books, records, accounts, officers,
directors, employees and office locations; requiring the PUC to adopt procedures
for reviewing transactions between the affiliates, enforcement measures for
violations and standards of conduct governing relationships between the
affiliates, specifying certain standards requirements and limits; regulating
incumbent local exchange carrier; specifying certain prohibited subsidies and
preferences by local telephone service providers; requiring the PUC to establish
standards of conduct for telecommunications providers, specifying certain
prohibited practices by ILECs and by telecommunications service providers;
providing for the confidentiality of customer data, requiring customer consent
for use, exceptions; specifying certain minimum service quality standards for
telecommunications service providers for consumer protection purposes; providing
for the resolution of customer inquiries and complaints; regulating rates,
terms, conditions and service discontinuation or disconnection; specifying
certain requirements for residential telecommunications service bills;
increasing the penalty assessment authority of the PUC; making conforming
amendments to certain statutory provisions relating to disclosure of local
service options, antislamming, discriminatory rates and fraudulent services;
specifying certain renumbering and cross reference change instructions to the
