A House resolution
providing for the impeachment of Keith Ellison, Attorney General of the State of
Minnesota, for corrupt conduct in office and for crimes and misdemeanors.
WHEREAS, article VIII, section 1, of the Minnesota Constitution provides the House of
Representatives the power of impeachment, and provides the Senate the power to try impeachments;
and
WHEREAS, Keith Ellison has failed to discharge faithfully the duties of his office to the
best of his judgment and ability, by engaging in corrupt conduct in office and committing crimes
and misdemeanors; NOW, THEREFORE,
BE IT RESOLVED by the House of Representatives of the State of Minnesota that Keith
Ellison, Attorney General of the State of Minnesota, is impeached for corrupt conduct in office and
for crimes and misdemeanors.
BE IT FURTHER RESOLVED that the following articles of impeachment are adopted by
the House of Representatives and must be exhibited to the Senate.
BE IT FURTHER RESOLVED that, in accordance with article VIII, section 3, of the
Minnesota Constitution, Keith Ellison must not exercise the duties of Attorney General from the
time this resolution is adopted and may resume the duties of Attorney General only if acquitted by
the Senate of the State of Minnesota.
BE IT FURTHER RESOLVED that, in accordance with article VIII, section 4, of the
Minnesota Constitution, the Speaker of the House of Representatives must ensure that Keith Ellison
is served with papers giving notice of the articles of impeachment as expeditiously as possible.
BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representatives is
directed to prepare an enrolled copy of this resolution, authenticated by his signature and that of
the Speaker, and transmit it to the Governor of Minnesota, the Secretary of State of Minnesota, and
the President and Secretary of the Senate.
The following articles of impeachment exhibited by the House of Representatives of the State
of Minnesota against Keith Ellison, Attorney General of the State of Minnesota, in maintenance
and support of impeachment for corrupt conduct in office and for crimes and misdemeanors:
ARTICLE I
Keith Ellison, Attorney General of the State of Minnesota, has violated his constitutional
oath of office by using the authority and public platform of the Office of Attorney General to defend,
excuse, or minimize unlawful conduct, including the unlawful entry, occupation, or disruption of
a religious facility during protest activity in Minnesota. This conduct constitutes an abuse of the
powers entrusted to his office; a failure to uphold and equally enforce the law; and a breach of the
duty of the Attorney General to protect the constitutional rights of all Minnesotans.
Wherefore, by virtue of the conduct described in this article, Keith Ellison warrants
impeachment, trial, and removal for corrupt conduct in office and for crimes and misdemeanors.
ARTICLE II
Keith Ellison, Attorney General of the State of Minnesota, has violated his constitutional
oath of office by undermining protections for religious liberty and worship.
The federal Freedom of Access to Clinics Entrance (FACE) Act expressly protects religious
worship and religious property from force, obstruction, or intentional interference. Keith Ellison:
(1) publicly defended or rationalized conduct that the FACE Act was enacted to deter;
(2) failed to affirm the seriousness of unlawful interference with religious worship; and
(3) used the authority of his office in a manner that undermines the purpose of federal and
state protections for religious liberty.
While the Attorney General does not directly prosecute federal crimes, he is obligated by
oath to respect and support the rule of law; cooperate with and not undermine federal civil rights
enforcement; and avoid conduct that signals selective tolerance for unlawful acts.
Wherefore, by virtue of the conduct described in this article, Keith Ellison warrants
impeachment, trial, and removal for corrupt conduct in office and for crimes and misdemeanors.
ARTICLE III
Keith Ellison, Attorney General of the State of Minnesota, has failed to neutrally and
impartially enforce the law.
Keith Ellison:
(1) exercised or signaled law enforcement discretion based on political or ideological
alignment;
(2) failed to clearly distinguish lawful protest from criminal conduct; and
(3) undermined public confidence in the impartial administration of justice.
Wherefore, by virtue of the conduct described in this article, Keith Ellison warrants
impeachment, trial, and removal for corrupt conduct in office and for crimes and misdemeanors.
ARTICLE IV
Keith Ellison, Attorney General of the State of Minnesota, has engaged in private
communications with members of a specific community in which he suggested preferential
protection, advocacy, or access involving public resources or enforcement discretion. Such conduct
constitutes a conflict of interest, the use of public office for functional or political advantage, and
a failure to act in a manner that is compatible with the duty to represent all Minnesotans.
Wherefore, by virtue of the conduct described in this article, Keith Ellison warrants
impeachment, trial, and removal for corrupt conduct in office and for crimes and misdemeanors.
ARTICLE V
Keith Ellison, Attorney General of the State of Minnesota, made representations implying
that political or financial support would be met with favorable treatment or protection connected
to his official role. These actions constitute an abuse of public office for the benefit of his campaign
interests; corrupt conduct; and a violation of the ethical duties of a state constitutional officer.
Wherefore, by virtue of the conduct described in this article, Keith Ellison warrants
impeachment, trial, and removal for corrupt conduct in office and for crimes and misdemeanors.
ARTICLE VI
Keith Ellison, Attorney General of the State of Minnesota, has engaged in conduct that brings
disrepute upon the Office of Attorney General, including undermining the rule of law; weakening
the protection for religious liberty; and damaging public trust in Minnesota's justice system.
Wherefore, by virtue of the conduct described in this article, Keith Ellison warrants
impeachment, trial, and removal for corrupt conduct in office and for crimes and misdemeanors.
