A bill for an act
relating to human services; phasing in nursing facility rates for private paying
residents; amending Minnesota Statutes 2014, section 256B.441, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 256B.441, is amended by adding a
subdivision to read:

new text begin Rate phase-in for private paying residents. new text end

new text begin Notwithstanding any other
law or rule to the contrary, nursing facility payment rates for private paying residents
shall not increase by more than five percent per year until such time as the rates for these
residents are equal to the rates approved by the commissioner for medical assistance
recipients under this section. The commissioner shall request from the federal Centers for
Medicare and Medicaid Services any waivers or federal approvals necessary to implement
this subdivision.

new text begin This section is effective January 1, 2016, or upon federal
approval, whichever is later. The commissioner shall notify the revisor of statutes when
federal approval is obtained.
