1.1 A bill for an act 1.2 relating to crime prevention and public safety; 1.3 providing that courts are not required to set bail 1.4 without nonmonetary conditions in certain instances 1.5 when releasing a defendant on pretrial release; 1.6 proposing coding for new law in Minnesota Statutes, 1.7 chapter 629. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. [629.472] [CONDITIONS OF RELEASE WITH OR 1.10 WITHOUT BAIL.] 1.11 If, when considering the pretrial release of a person 1.12 charged with a crime, a court decides to impose conditions of 1.13 release on the person that are designed: 1.14 (1) to protect the alleged victim, the alleged victim's 1.15 family or household members, or witnesses to the alleged crime; 1.16 (2) to ensure the person's appearance at trial; or 1.17 (3) to ensure that the person remains law abiding; 1.18 the court is not required to fix monetary bail without other 1.19 conditions upon which the defendant may obtain release. In 1.20 these instances, the court may impose reasonable conditions of 1.21 release upon the person either with or without setting bail. 1.22 Sec. 2. [RULE SUPERSEDED.] 1.23 Minnesota Rules of Criminal Procedure, rule 6.02, 1.24 subdivision 2, is superseded to the extent it conflicts with 1.25 section 1.
