A bill for an act
relating to local government; modifying definitions relating to self-insurance and
the Nonprofit Insurance Trust; amending Minnesota Statutes 2014, sections
471.98, subdivision 2; 471.982, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 471.98, subdivision 2, is amended to read:


Subd. 2.

Political subdivision.

"Political subdivision" includes a statutory or home
rule charter city, a county, a school district, a town, a watershed management organization
as defined in section 103B.205, subdivision 13, or an instrumentality thereof, including
but not limited to instrumentalities incorporated under chapter 317A, having independent
policy-making and appropriating authority. For the purposes of this section and section
471.981, the governing body of a town is the town board. deleted text begin The term also includes the
Nonprofit Insurance Trust incorporated under chapter 317A and its members incorporated
under chapter 317A.

Sec. 2.

Minnesota Statutes 2014, section 471.982, subdivision 3, is amended to read:


Subd. 3.

Exemptions.

Self-insurance pools established and open for enrollment
on a statewide basis by the Minnesota League of Cities Insurance Trust, the Minnesota
School Boards Association Insurance Trust, the Minnesota Association of Townships
Insurance and Bond Trust, new text begin or new text end the Minnesota Counties Intergovernmental Trustdeleted text begin , or the
Nonprofit Insurance Trust
deleted text end and the political subdivisions that belong to them are exempt
from the requirements of this section and sections 65B.48, subdivision 3, and 60A.0811.
In addition, the Minnesota Association of Townships Insurance and Bond Trust and the
townships that belong to it are exempt from the requirement to hold the certificate of surety
authorization issued by the commissioner of commerce as provided in section 574.15.
