A bill for an act
relating to transportation; requiring notice and coordination for certain
transportation improvements and major projects; proposing coding for new law
in Minnesota Statutes, chapter 174.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

MAJOR PROJECTS.

new text begin (a) Except in an emergency, the commissioner shall notify
the legislators serving the area where transportation improvements or major maintenance
projects are planned or proposed of the improvement or maintenance at least 16 months
prior to initiation of the project. The notice must include:

new text begin (1) an explanation detailing the need for the improvement or maintenance;
new text end

new text begin (2) options considered or under consideration;
new text end

new text begin (3) any proposed citizen and community engagement plan;
new text end

new text begin (4) an estimate of the project cost; and
new text end

new text begin (5) the proposed construction schedule.

new text begin (b) If a transportation improvement or major maintenance project will disrupt local
traffic for more than six months, the notice provided by the commissioner under paragraph
(a) must occur at least 24 months prior to initiation of the project.

new text begin (a) After providing notice under subdivision 1,
the commissioner shall collaborate with affected legislators and local elected officials to
develop a final citizen and community engagement plan.

new text begin (b) When a transportation improvement or major maintenance project will
significantly disrupt area businesses and residents, the commissioner should, to the
maximum extent possible, engage other state and local officials to coordinate other needed
improvements to the project area.

new text begin (c) When considering project implementation alternatives for projects that will
negatively impact access to ten or more businesses, maximum consideration shall be
given to options or alternatives that minimize the negative impact on businesses in the
project area.
