3E Relating to public safety

ARTICLE 1 - METHAMPHETAMINE PROVISIONS

Expanding
the definition of narcotic drug to include methamphetamine; increasing penalties
for possession of substances with intent to manufacture methamphetamine;
requiring the court to order restitution for certain controlled or precursor
substance offenses; imposing certain property related prohibitions for
clandestine lab sites, specifying certain notice requirements of arresting peace
officers and of certain authorities and certain recording requirements and
providing for cleanup, imposing liability of contractors verifying cleanup
completion before full remediation; specifying certain property information
maintenance requirements of local community health services administrators,
requiring the commissioner of health to post contact information on the web
site; specifying certain disclosure requirements for the sale or transfer of
real property, imposing liability on the seller for failure to comply; further
regulating and recodifying activities involving the use of anhydrous ammonia,
specifying certain prohibited conduct and imposing criminal penalties and civil
liability; establishing methamphetamine related crimes involving children and
vulnerable adults, imposing criminal penalties and providing for multiple
sentences, providing for the taking of children into protective custody and
requiring the reporting of maltreatment of vulnerable adults; requiring
certificates of title for motor vehicles contaminated by methamphetamine
production to notate a hazardous waste contaminated vehicle condition; requiring
peace officer notice to schools of children taken into protective custody due to
methamphetamine manufacture or storage; establishing a methamphetamine
laboratory cleanup revolving fund for loans to assist cities and counties in
methamphetamine cleanup, specifying loan application and eligibility
requirements and providing for disbursement of funds; expanding the definition
of violent crime to methamphetamine related crimes involving children and
vulnerable adults for mandatory sentencing purposes; specifying certain
recodification instructions to the revisor of statutes

ARTICLE 2 -
METHAMPHETAMINE APPROPRIATIONS

Appropriating money to the commissioner of
corrections for increased prison population, to the board of public defense for
a methamphetamine trial team, to the commissioner of human services to fund a
certain number of pilot projects addressing methamphetamine, to the commissioner
of employment and economic development (DEED) to carry out the duties of the
public facilities authority involving the methamphetamine laboratory cleanup
revolving fund, to the commissioner of public safety for additional bureau of
criminal apprehension (BCA) agents, to the commissioner of health to provide
technical assistance on methamphetamine lab remediation and to the commissioner
of education to develop and distribute materials to schools addressing the
dangers of methamphetamine
