                        CHAPTER 384-H.F.No. 2427 
           An act relating to state lands; authorizing exchange 
          of state property with Minnesota transportation museum 
          property. 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
    Section 1.  [EXCHANGE OF DULUTH JUNCTION TRAIL PROPERTY FOR 
MINNESOTA TRANSPORTATION MUSEUM PROPERTY.] 
    Subdivision 1.  [AUTHORIZATION.] Notwithstanding Minnesota 
Statutes, sections 94.341 to 94.349, or any other law, the 
commissioner of natural resources may exchange the state 
property described in subdivision 3 for the property of the 
Minnesota Transportation Museum, Incorporated, described in 
subdivision 4 by September 1, l986. 
    Subd. 2.  [EXCHANGE.] The exchange shall be by quitclaim 
deed from both parties in a form approved by the attorney 
general.  The commissioner may exchange the property if the 
exchange is approved by the land exchange board. 
    Subd. 3.  [STATE PROPERTY.] The state may exchange the 
property described in this subdivision for the Minnesota 
Transportation Museum, Incorporated, property described in 
subdivision 4.  
    That part of the former Soo Line Railroad right-of-way 
located in the Northwest Quarter of the Northwest Quarter of 
Section 23, Township 30 North, Range 21 West, Washington County, 
Minnesota, and described as follows: 
    (a) A strip of land 27.50 feet in width lying between lines 
5.00 feet to the right and 32.50 feet to the right of a line, 
hereinafter described as "Line A." 
    (b) Also a strip of land 50.00 feet in width lying 17.50 
feet to the left and 32.50 feet to the right of a line, 
hereinafter described as "Line B." 
    "Line A" is described as beginning at a point on the center 
line of the former Soo Line Railroad distance 1100.00 feet 
southwesterly of, as measured along said center line, from its 
intersection with the center line of the Minnesota 
Transportation Museum, Incorporated, right-of-way; thence 
northeasterly along said center line of the former Soo Line 
Railroad 175.00 feet and there terminating. 
    "Line B" is described as beginning at the terminus of said 
"Line A"; thence northeasterly along said center line of the 
former Soo Line Railroad 731.63 feet; thence northeasterly along 
a tangential curve concave to the southeast having a radius of 
818.51 feet and a central angle of 26 degrees 35 minutes for a 
distance of 92.20 feet to the southerly right-of-way line of the 
said Minnesota Transportation Museum, Incorporated, right-of-way 
and there terminating. 
    The side lines of said strip of land are prolonged or 
shortened to terminate on said southerly right-of-way line of 
the Minnesota Transportation Museum, Incorporated, right-of-way. 
     Also, that part lying southeasterly of a line 32.50 feet to 
the right of the above-described "Line B," southerly of the 
southerly right-of-way of the Minnesota Transportation Museum, 
Incorporated, and northeasterly of the following described line: 
     Commencing at the intersection of the northerly 
right-of-way lines of the former Soo Line Railroad and the 
Minnesota Transportation Museum, Incorporated, right-of-way; 
thence westerly along said northerly right-of-way line of the 
Minnesota Transportation Museum, Incorporated, 33.00 feet; 
thence southerly deflecting to the left 80 degrees 00 minutes a 
distance of 101.54 feet to the southerly right-of-way line of 
the Minnesota Transportation Museum, Incorporated; thence 
southeasterly deflecting to the left 25 degrees 00 minutes a 
distance of 50 feet, more or less, to a line 32.50 feet to the 
right of the above-described "Line B" and the point of 
beginning; thence continuing southeasterly along the last 
described line a distance of 40 feet, more or less, to the 
southerly right-of-way line of the former Soo Line Railroad and 
there terminating. 
    (d) Together with a permanent easement for ingress and 
egress over and across a strip of land 10.00 feet in width lying 
northerly of, adjacent and contiguous to, the above described 
27.50 foot and 50.00 foot wide strips of land. 
    Subd. 4.  [MINNESOTA TRANSPORTATION MUSEUM, INCORPORATED, 
PROPERTY.] The Minnesota Transportation Museum, Incorporated, 
may exchange the property described in this subdivision for the 
state of Minnesota property described in subdivision 3. 
    (a) That part of the Minnesota Transportation Museum, 
Incorporated, right-of-way located in the Northwest Quarter of 
the Northwest Quarter of Section 23, Township 30 North, Range 21 
West, Washington County, Minnesota, lying within the former Soo 
Line Railroad right-of-way and northerly of a line 17.50 feet 
northerly of the hereinafter described "Line C." 
    "Line C" is described as commencing at a point on the 
center line of the former Soo Line Railroad distance 1100.00 
feet southwesterly of, as measured along said center line, from 
its intersection with the center line of the Minnesota 
Transportation Museum, Incorporated, right-of-way; thence 
northeasterly along said center line of the former Soo Line 
Railroad 906.63 feet to the point of beginning; thence 
northeasterly along a tangential curve concave to the southeast 
having a radius of 818.51 feet and a central angle of 26 degrees 
35 minutes for a distance of 379.76 feet; thence easterly, 
tangent to said curve, 100.00 feet and there terminating. 
    (b) Also a strip of land 33.00 feet in width lying 16.50 
feet on each side of the following described center line: 
    Commencing at the intersection of the northerly 
right-of-way lines of the former Soo Line Railroad and the 
Minnesota Transportation Museum, Incorporated; thence westerly 
along said northerly right-of-way line of the Minnesota 
Transportation Museum, Incorporated, 16.50 feet to the point of 
beginning; thence southerly deflecting to the left 80 degrees 00 
minutes a distance of 10 feet, more or less, to said northerly 
right-of-way line of the former Soo Line Railroad and there 
terminating. 
    The side lines of said strip of land are prolonged or 
shortened to terminate on said northerly right-of-way lines of 
the former Soo Line Railroad and the Minnesota Transportation 
Museum, Incorporated. 
    (c) The grantors, for themselves, their successors and 
assigns, reserve a perpetual easement subject to the conditions 
expressly provided herein, for ingress and egress over and 
across that part of the above conveyed lands described as 
follows: 
    A strip of land 10.00 feet in width lying 17.50 feet 
northerly of and parallel with the above described "Line C." 
    (d) Also a strip of land 33.00 feet in width lying 16.50 
feet on each side of the following described center line: 
    Commencing at the intersection of the northerly 
right-of-way lines of the former Soo Line Railroad and Minnesota 
Transportation Museum, Incorporated; thence westerly along said 
northerly right-of-way line of the Minnesota Transportation 
Museum, Incorporated, 16.50 feet to the point of beginning; 
thence southerly deflecting to the left 80 degrees 00 minutes a 
distance of 90 feet, more or less, to the southerly boundary of 
the above described conveyed lands and there terminating.  
    Subd. 5.  [EASEMENT.] The state shall have the right to use 
the easement under subdivision 3, paragraph (d), for any public 
purpose in common with the Minnesota Transportation Museum, 
Incorporated.  Neither the state or the Minnesota Transportation 
Museum, Incorporated, may fence or in any manner prevent the 
other from access over and across the easement under subdivision 
3, paragraph (d), or subdivision 4, paragraph (c), to any of the 
above exchanged property. 
    Subd. 6.  [PURPOSE.] The property exchanged under this 
section is necessary for the Minnesota Transportation Museum, 
Incorporated, to use the railroad tracks for exhibits of the 
museum.  The Duluth junction trail is adjacent to the museum 
property and can use the museum property for the trail. 
    Sec. 2.  [EFFECTIVE DATE.] 
    This act is effective the day following final enactment.
