A bill for an act
relating to health; requiring the commissioner of health to permit hospitals to obtain
opiate antagonists through a web-based portal; proposing coding for new law in
Minnesota Statutes, chapter 144.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) For purposes of this section, "opiate antagonist" has the meaning given in section
604A.04, subdivision 1.

new text begin (b) The commissioner of health must allow hospitals licensed under sections 144.50 to
144.56 to obtain opiate antagonists through the web-based portal for distribution of opiate
antagonists that is administered by the commissioner. A hospital may distribute opiate
antagonists obtained through the portal to a patient, upon discharge, who may need an opiate
antagonist in the future, including a patient who:

new text begin (1) exhibited symptoms of opioid use disorder upon admission or during the patient's
hospital stay; or

new text begin (2) was treated for opioid use disorder or an opioid overdose.

new text begin (c) A hospital is not required to order or obtain opiate antagonists through the portal
specified in paragraph (b).
