A bill for an act
relating to transportation; establishing a pavement art pilot program; requiring a
report; appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin (a) For purposes of this section, the following terms have
the meanings given.

new text begin (b) "Commissioner" means the commissioner of transportation.

new text begin (c) "Pilot program" means the pavement art pilot program established in this section.

new text begin In conformance with this section, the commissioner must
establish a pavement art pilot program for artwork installations applied to roadway pavement.

new text begin (a) In conducting the pilot program, the commissioner must:
new text end

new text begin (1) arrange for installation of:
new text end

new text begin (i) at least five art projects located in the Department of Transportation metropolitan
district, including one at the intersection of marked Trunk Highway 55, also known as Olson
Memorial Highway, and Van White Memorial Boulevard in the city of Minneapolis; and
new text end

new text begin (ii) at least five art projects located outside the metropolitan district;
new text end

new text begin (2) locate the art projects in trunk highway rights-of-way;
new text end

new text begin (3) require that the artwork installation is primarily applied to the roadway or shoulder;
new text end

new text begin (4) require that a vehicle can be safely operated on any portion of the artwork installation
applied to the roadway or shoulder;
new text end

new text begin (5) provide for each art project to remain in place for at least one year;
new text end

new text begin (6) make efforts to identify and enter into agreements with artists from the community
in which the art project is placed; and
new text end

new text begin (7) perform public engagement that includes solicitation and collection of community
input.

new text begin (b) An artwork installation under the pilot program may include artwork on the curb,
sidewalk, or other facilities located in the trunk highway right-of-way, in addition to the
artwork placed on the roadway or shoulder.

new text begin The commissioner must analyze and evaluate:
new text end

new text begin (1) pavement art safety impacts, which must include analysis of: (i) safety of vulnerable
road users, including but not limited to pedestrians and bicyclists; (ii) motor vehicle crash
rates and severity; and (iii) speeding;

new text begin (2) durability of the installation art materials; and
new text end

new text begin (3) visibility of art projects in winter conditions.

new text begin By January 15, 2026, the commissioner must submit a report on the
pavement art pilot program to the chairs and ranking minority members of the legislative
committees and divisions with jurisdiction over transportation policy and finance. At a
minimum, the report must provide an overview of the pilot program, review the art projects,
and provide findings from the evaluation under subdivision 4.

Sec. 2. new text begin APPROPRIATION; PAVEMENT ART PILOT PROGRAM.

new text begin $500,000 in fiscal year 2025 is appropriated from the trunk highway fund to the
commissioner of transportation for the pavement art pilot program under section 1. This is
a onetime appropriation.
