A bill for an act
relating to human services; requiring the commissioner of human services to submit
an application for a 1115 demonstration waiver to provide substance use disorder
treatment services to incarcerated individuals.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin DIRECTION TO COMMISSIONER OF HUMAN SERVICES; 1115
DEMONSTRATION WAIVER.

new text begin (a) Within 120 calendar days of the effective date of this section, the commissioner of
human services must apply to the secretary of health and human services for a 1115
demonstration waiver. The commissioner must include in the application a request to cover
under the proposed demonstration project the following services that are provided to
individuals confined in state prisons, county jails, and other secure settings:

new text begin (1) screening, assessment, and brief intervention while incarcerated;

new text begin (2) medications for treating substance use disorders, specifically including various
preparations of buprenorphine for the treatment of opioid use disorder;

new text begin (3) certified peer recovery support services;
new text end

new text begin (4) culturally specific recovery supports;
new text end

new text begin (5) American Society of Addiction Medicine levels of care appropriate for the setting;
and
new text end

new text begin (6) referral to substance use disorder treatment upon release.

new text begin (b) Services must be consistent with the statutory directive in the Substance Use-Disorder
Prevention that Promotes Opioid Recovery and Treatment for Patients and Communities
Act, Public Law 115-271, section 5032, and federal guidance.

new text begin (c) When preparing the application for the 1115 demonstration waiver, the commissioner
of human services must consult with the commissioner of corrections, sheriffs, lead agencies,
and individuals with lived experience of incarceration.
