A bill for an act
 relating to local government; permitting recovery from a municipality for damages
related to a sewage backup; creating a private right of action; proposing coding
for new law in Minnesota Statutes, chapter 466.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Notwithstanding section 466.03, subdivision 6, a person may bring an action against a
municipality to recover damages if an officer, employee, or agent of the municipality acting
within the scope of office or employment committed an act or failed to commit an act that
resulted in a sewage backup on the person's property.
