relating to public safety; establishing the Task Force on the Viability of Aging
State Correctional Facilities; requiring a report.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin TASK FORCE ON THE VIABILITY OF AGING STATE
CORRECTIONAL FACILITIES.

new text begin The Task Force on the Viability of Aging State
Correctional Facilities is established to advise the legislature on the continued viability of
the state correctional facilities located in St. Cloud and Stillwater.

new text begin Subd. 2. new text end

new text begin Membership. new text end

new text begin (a) The task force shall consist of the following members:
new text end

new text begin (1) the commissioner of corrections or a designee;
new text end

new text begin (2) the commissioner of administration or a designee;
new text end

new text begin (3) the chairs of the house of representatives and senate committees with jurisdiction
over capital investment and public safety;
new text end

new text begin (4) a legislator from Senate District 14;
new text end

new text begin (5) a legislator from Senate District 33;
new text end

new text begin (6) the ombudsperson for corrections or a designee;
new text end

new text begin (7) the capital resource director at the Department of Corrections;
new text end

new text begin (8) a warden of a state correctional facility appointed by the commissioner of corrections;
new text end

new text begin (9) a representative from the American Federation of State, County and Municipal
Employees appointed by that organization;
new text end

new text begin (10) a representative from the Minnesota Association of Professional Employees
appointed by that organization;
new text end

new text begin (11) a person formerly incarcerated at the state correctional facility in Stillwater appointed
by the governor;
new text end

new text begin (12) a person formerly incarcerated at the state correctional facility in St. Cloud appointed
by the governor;
new text end

new text begin (13) a representative of the National Alliance on Mental Illness Minnesota appointed
by that organization;
new text end

new text begin (14) a representative of the Minnesota Sheriffs' Association appointed by the association;
new text end

new text begin (15) a public health expert appointed by the commissioner of health;
new text end

new text begin (16) a representative of a criminal justice reform advocacy organization appointed by
the governor;
new text end

new text begin (17) a security expert appointed by the governor; and
new text end

new text begin (18) a private sector employment and economic development expert appointed by the
governor.

new text begin (b) Members shall be designated or appointed to the task force by September 1, 2024.
new text end

new text begin (c) Members of the task force serve without compensation.
new text end

new text begin (d) Members of the task force serve at the pleasure of the appointing authority or until
the task force expires. Vacancies shall be filled by the appointing authority consistent with
the qualifications of the vacating member required by this subdivision.

new text begin Organization; meetings. new text end

new text begin (a) The commissioner of corrections or the
commissioner's designee shall convene the first meeting of the task force by October 1,
2024.

new text begin (b) At the first meeting, the members of the task force shall elect a chair and other officers
as the members deem necessary.
new text end

new text begin (c) The task force shall meet monthly or as determined by the chair. The task force shall
meet sufficiently enough to accomplish the tasks identified in this section.

new text begin (d) Meetings of the task force are subject to Minnesota Statutes, chapter 13D. Task force
meetings must be recorded and available to the public on the website of the Department of
Corrections.

new text begin Staff; meeting space. new text end

new text begin The commissioner of corrections shall provide support
staff, office and meeting space, and administrative services for the task force.

new text begin The task force shall evaluate the viability of the state correctional
facilities located in St. Cloud and Stillwater including an assessment of potential costs,
benefits, and impacts of both repairing and replacing the correctional facilities.

new text begin The task force must file a report with the commissioner of corrections
and the chairs and ranking minority members of the senate and house of representatives
committees and divisions with jurisdiction over public safety and capital investment on the
evaluation completed under subdivision 5 on or before February 1, 2025.

new text begin The task force expires the day after submitting its report under
subdivision 6.
