A bill for an act
relating to human services; providing 12-month continuous medical assistance
eligibility for adults; amending Minnesota Statutes 2023 Supplement, section
256B.056, subdivision 7.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2023 Supplement, section 256B.056, subdivision 7, is
amended to read:


Subd. 7.

Period of eligibility.

(a) Eligibility is available for the month of application
and for three months prior to application if the person was eligible in those prior months.
A redetermination of eligibility must occur every 12 months.

(b) Notwithstanding any other law to the contrary:

(1) a child under 19 years of age who is determined eligible for medical assistance must
remain eligible for a period of 12 months;

(2) a child 19 years of age deleted text begin anddeleted text end new text begin ornew text end older but under 21 years of age who is determined
eligible for medical assistance must remain eligible for a period of 12 months; deleted text begin and
deleted text end

(3) a child under six years of age who is determined eligible for medical assistance must
remain eligible through the month in which the child reaches six years of agedeleted text begin .deleted text end new text begin ; and

new text begin (4) a person 21 years of age or older whose medical assistance eligibility is determined
using the modified adjusted gross income methodology, as specified in subdivision 1a,
paragraph (b), must remain eligible for a period of 12 months.

if:

(1) the deleted text begin child or the child'sdeleted text end new text begin individual or the individual'snew text end representative requests voluntary
termination of eligibility;

(3) the deleted text begin childdeleted text end new text begin individualnew text end dies;

(4) the deleted text begin childdeleted text end new text begin individualnew text end attains the maximum agenew text begin , if applicablenew text end ; or

(5) the agency determines eligibility was erroneously granted at the most recent eligibility
determination due to agency error or fraud, abuse, or perjury attributed to the deleted text begin child or the
child's
deleted text end new text begin individual or the individual'snew text end representative.

(d) For a person eligible for an insurance affordability program as defined in section
256B.02, subdivision 19, who reports a change that makes the person eligible for medical
assistance, eligibility is available for the month the change was reported and for three months
prior to the month the change was reported, if the person was eligible in those prior months.

whichever is later. The commissioner of human services shall notify the revisor of statutes
when federal approval is obtained.
