A bill for an act
relating to human services; establishing a supplemental food assistance program
for persons with a disability; proposing coding for new law in Minnesota Statutes,
chapter 256D.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

PERSONS WITH A DISABILITY.

new text begin The commissioner of human services shall establish a
supplemental food assistance program for persons with a disability to provide supplemental
food assistance to persons with a disability who is eligible for the federal Supplemental
Nutrition Assistance Program (SNAP), but not eligible for the maximum federal SNAP
benefit for the person's household size due to excess income.

new text begin (a) For the purposes of this section, the following terms have the
meanings given unless otherwise provided.

new text begin (b) "Commissioner" means the commissioner of human services.
new text end

new text begin (c) "Person with a disability" has the meaning given in section 245D.02, subdivision 23.

new text begin To be eligible for the supplemental food assistance
program for persons with a disability, an applicant must:

new text begin (1) meet the initial and ongoing eligibility requirements for federal SNAP benefits;

new text begin (2) be a person with a disability;
new text end

new text begin (3) be a resident of the state; and
new text end

new text begin (4) not be receiving assistance under the Minnesota family investment program.

new text begin An eligible person must apply for the supplemental food assistance
program for persons with a disability on the forms and according to the timelines established
by the commissioner.

new text begin Benefit amount. new text end

new text begin (a) The benefit amount provided under this section is equal
to the difference between the maximum benefit amount for a person's household size under
the federal SNAP and the actual federal SNAP benefit amount calculated for the person.

new text begin (b) The monthly benefit provided under this section must not exceed an amount equal
to the amount of federal SNAP benefits the household would receive if all members of the
household were eligible for the federal SNAP benefits.

new text begin (c) The commissioner shall redetermine a program recipient's eligibility for the program
under this section and benefit amount at the time of federal SNAP eligibility redetermination.

as income in all programs that do not count SNAP benefits as income.
