A bill for an act
relating to transportation; requiring the Department of Public Safety to add deputy
registrars and driver's license agents to state agencies eligible to provide bilingual
services and materials; amending Minnesota Statutes 2022, section 15.441, by
adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 15.441, is amended by adding a subdivision
to read:

new text begin (a) Notwithstanding
any statute or rule to the contrary, the commissioner of public safety, in consultation with
the commissioner of administration, must determine the application of this section to deputy
registrars appointed under section 168.33 and driver's license agents appointed under section
171.061. If the commissioner of public safety determines that a deputy registrar's office
location serves a substantial number of non-English speaking people on a yearly basis, the
commissioner must produce equivalent materials in any non-English language spoken by
a substantial number of people served by the deputy registrar location. If the commissioner
of public safety determines that a driver's license agent serves a substantial number of
non-English speaking people on a yearly basis, the commissioner must produce equivalent
materials in any non-English language spoken by a substantial number of people served by
the driver's license agent.

new text begin (b) Notwithstanding any statute or rule to the contrary, the commissioner of administration
must determine the application of this section to county deputy registrars appointed under
section 168.33, subdivision 2, and to driver's license agents appointed under section 171.061,
subdivision 2, who provide services at county service offices. If the commissioner determines
that the deputy registrar or driver's license agent at the county service office serves a
substantial number of non-English speaking people, the commissioner of public safety must
provide translations of materials explaining agency services to the county service office.

new text begin (c) A private deputy registrar or driver's license agent is encouraged to provide its location
with written materials in the appropriate non-English language when:

new text begin (1) the location serves a substantial number of non-English speaking people;
new text end

new text begin (2) written materials such as applications, forms, letters, notices, or any documents are
used to ask or order a person to provide information or to give a person information; or

new text begin (3) the information asked for or given could affect the person's rights, duties, or privileges
under chapters 168, 168A, and 171.
