A bill for an act
relating to corrections; providing communication services for incarcerated persons;
proposing coding for new law in Minnesota Statutes, chapter 241.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [241.252] COMMUNICATION SERVICES ACCESS.

new text begin (a) A state correctional facility and state licensed facility for adults or juveniles shall
provide incarcerated persons with voice communication service. The facilities may
supplement voice communication service with other communication services including but
not limited to video communication and email or electronic messaging services. To the
extent that voice communication service or any other communication service is provided,
which shall not be limited beyond program participation and routine facility procedures,
each service shall be provided free of charge to the person initiating and the person receiving
the communication.

new text begin (b) No state agency shall receive revenue from the provision of voice communication
services or any other communication services to any person confined in a state correctional
facility or youth residential placement or detention center.

new text begin (c) Facilities shall maintain in-person visits for incarcerated persons in accordance with
Minnesota Rules, part 2911.3200. Communications services shall not be used to replace
the in-person visit program.
