A bill for an act
relating to nursing facilities; requiring the commissioner of health to correct an
estimated property rate adjustment for a nursing facility project.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

To address good-faith errors in the calculation of the estimated fair rental value property
rate that occurred with the initial proposal for an exception under Minnesota Statutes, section
144A.073, the commissioner of health shall correct the estimated property rate adjustment
for a project that was proposed for a 70-bed nursing facility located in Chisholm and approved
under Minnesota Statutes, section 144A.073, on April 19, 2020, by increasing that nursing
facility's property rate by $9.49, effective July 1, 2023. This amount shall be removed from
that nursing facility's property rate once a new property rate is calculated for that nursing
facility under Minnesota Statutes, section 256R.265, based on an updated appraisal.
