A bill for an act
relating to state agencies; transferring the school nutrition programs unit from the
Department of Education to the Department of Agriculture.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin TRANSFER OF DUTIES.

new text begin By July 1, 2023, the commissioner of education must, with the necessary approval by
the United States Department of Agriculture, in coordination with the commissioner of
agriculture, and pursuant to Minnesota Statutes, section 15.039, transfer the unit responsible
for conducting school nutrition programs under Minnesota Statutes, chapter 124D, from
the Department of Education to the Department of Agriculture. The transfer must include
all employees, books, accounts, documents, data of any classification, and all property
required to carry out the duties of the school nutrition program unit under Minnesota Statutes,
chapter 124D.

Sec. 2. new text begin WAIVER REQUEST.

new text begin By September 30, 2022, the commissioner of education must submit any federal waivers
and approvals necessary to implement the transfer of duties under this act. The commissioner
must inform the chairs and ranking minority members of the legislative committees with
jurisdiction over kindergarten through grade 12 education when the waiver request is
submitted along with a copy of the submitted waiver. The commissioner must also inform
the chairs and ranking minority members of the legislative committees with jurisdiction
over kindergarten through grade 12 education of any federal action regarding this request.

Sec. 3. new text begin REVISOR INSTRUCTION.

new text begin The revisor of statutes, in consultation with staff from the House Research Department;
House Fiscal Analysis; the Office of Senate Counsel, Research, and Fiscal Analysis; and
the respective departments, must prepare legislation for introduction in the 2023 legislative
session proposing the statutory changes needed to implement the transfer of duties required
by this act.
