A bill for an act
relating to public safety; establishing a duty for peace officers to report excessive
force incidents to the chief law enforcement officer; proposing coding for new law
in Minnesota Statutes, chapter 626.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

A peace officer who observes another peace officer use force that
the officer reasonably believes exceeds the degree of force permitted by law or policy has
the duty to report the incident to the chief law enforcement officer of the agency that employs
the reporting peace officer.

A peace officer who breaches the duty to report established in this
subdivision is subject to discipline by the board under Minnesota Rules, part 6700.1600.

The board shall adopt a reporting form to be used by law enforcement
agencies in making the reports required under this section. The reports must include for
each incident all of the following:

(1) the date of the incident;

(2) the location of the incident;
new text end
new text begin
(3) the name of the victim, if known; and

(4) a description of the force used in the incident.
