A bill for an act
relating to housing; prohibiting state funding to proposed projects of certain public
housing authorities with a low physical inspection score; amending Minnesota
Statutes 2020, section 462A.05, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2020, section 462A.05, is amended by adding a subdivision
to read:

(a) For the purposes of this
subdivision, the following terms have the meanings given:

(1) "public housing agency" means a public housing agency under the United States
Housing Act of 1937, as amended; and

(2) "public housing project" has the meaning given under Code of Federal Regulations,
title 24, section 990.115.

(b) The agency may not expend funds on any proposal where a housing project will
receive capital or operating assistance from a public housing agency that owns or operates
a public housing project containing 200 or more public housing units with a physical
inspection score of less than 60 points, as calculated under Code of Federal Regulations,
title 24, sections 902.20 to 902.26. This restriction is lifted if the proposal provides
documentation that the low-scoring public housing project has at least four months of
operating reserve and sufficient funding to correct the inspection deficiencies.
