A bill for an act
relating to transportation; establishing a reintegration license for certain individuals
released from custody; proposing coding for new law in Minnesota Statutes, chapter
171.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Conditions of issuance. new text end

new text begin (a) The commissioner may issue a reintegration
driver's license to any person:

new text begin (1) who has been released from a period of at least 180 consecutive days of confinement
or incarceration in any adult correctional facility either under the control of the commissioner
of corrections or licensed by the commissioner of corrections under section 241.021; and

new text begin (2) whose license has been suspended, revoked, canceled, or denied under the
circumstances listed in section 171.30, subdivision 1, paragraph (a), clauses (1) to (4).

new text begin (b) If the person's driver's license or permit to drive has been revoked under section
169.792 or 169.797, the commissioner may only issue a reintegration driver's license to the
person after the person has presented an insurance identification card, policy, or written
statement indicating that the driver or owner has insurance coverage satisfactory to the
commissioner.

new text begin (c) The commissioner must not issue a reintegration driver's license to any person
described in section 171.04, subdivision 1, clause (7), (8), or (11).

new text begin (d) The commissioner must not issue a class A, class B, or class C reintegration driver's
license.

new text begin (a) A person seeking a reintegration driver's
license must apply for the license within one year of release from confinement or
incarceration. The application must be made in a format approved by the commissioner.

new text begin (b) The commissioner may not charge an application fee or a license fee for a reintegration
driver's license.

new text begin Subd. 3. new text end

new text begin Cancellation of license. new text end

new text begin The commissioner must cancel the reintegration driver's
license of any person who commits a violation that would result in the suspension, revocation,
or cancellation of a driver's license. A person whose reintegration driver's license is canceled
under this subdivision may not be issued another reintegration driver's license and may not
operate a motor vehicle for the remainder of the period of suspension or revocation, or 30
days, whichever is longer.

new text begin Reinstatement of full driving privileges. new text end

new text begin Notwithstanding any statute or rule
to the contrary, the commissioner must reinstate full driving privileges of a person who was
issued a reintegration driver's license provided:

new text begin (1) the person has possessed the reintegration driver's license for one full year;
new text end

new text begin (2) the reintegration driver's license has not been canceled pursuant to subdivision 3;
new text end

new text begin (3) the person's reintegration driver's license was not suspended pursuant to section
171.186 for nonpayment of child support; and

new text begin (4) the person pays the applicable license fee pursuant to section 171.06, subdivision 2,
and any applicable endorsement fee under section 171.06, subdivision 2a.
