A bill for an act
relating to capital investment; appropriating money for a municipal district heating
and cooling energy distribution system in the city of Rochester.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin DISTRICT ENERGY SYSTEM; ROCHESTER; APPROPRIATION.

new text begin $15,800,000 is appropriated from the general fund in fiscal year 2023 to the commissioner
of commerce for a grant to the city of Rochester for the municipal district heating and
cooling energy distribution system connecting the Mayo Civic Center, Rochester City Hall,
Rochester Art Center, Rochester Civic Theater, and Rochester Public Library with capacity
to connect to future public and private developments on other nearby property sites. This
appropriation may be used for one or more of the project elements or phases: predesign,
design, engineering, construction, and equipping the facility, systems, and infrastructure,
including capital improvements related to renewable energy sources such as solar thermal,
geothermal, solar panels, and replacement of building controls. In addition, expenditures
made by the city before enactment of this section related to predesign, design, and engineering
are included in the nonstate contribution to the project. This appropriation is available when
the commissioner of management and budget determines that sufficient resources have been
committed to complete the project from nonstate sources. This is a onetime appropriation
and is available until the project is completed or abandoned subject to Minnesota Statutes,
section 16A.642.
