A bill for an act
relating to local government; requiring the county board to withhold the sheriff's
salary for the remainder of the sheriff's term if the sheriff is convicted of driving
while impaired; amending Minnesota Statutes 2020, section 387.20, by adding a
subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2020, section 387.20, is amended by adding a subdivision
to read:

Notwithstanding
subdivision 2, paragraph (d), if the sheriff is convicted of a violation of section 169A.20,
the county board must withhold the salary of the sheriff from the date of the conviction
through the remainder of the term for which the sheriff was elected or appointed.

This section is effective the day following final enactment and
applies retroactively to any sheriff convicted on or after July 1, 2021.
