A bill for an act
relating to capital investment; appropriating money for flood hazard mitigation
projects in the Red River Basin; authorizing the sale and issuance of state bonds.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin Appropriation. new text end

new text begin (a) $47,057,000 is appropriated from the bond proceeds
fund to the commissioner of natural resources for the state share of flood hazard mitigation
grants for publicly owned capital improvements to prevent or alleviate flood damage under
Minnesota Statutes, section 103F.161, subdivision 3, and to enhance natural resources.
Notwithstanding Minnesota Statutes, section 103F.161, subdivision 2, a grant for
implementation of a flood hazard mitigation project in the Red River basin, consistent with
the 1998 mediation agreement and approved by the Red River flood damage reduction work
group, may be for up to 75 percent of the cost of the proposed mitigation measures. Of this
appropriation:

new text begin (1) $12,900,000 is for Phase 1 and Phase 2 construction of the Redpath impoundment
to Bois de Sioux Watershed District;

new text begin (2) $625,000 is for the Perley Phase 2 road raise completing a flood protection levee to
the Wild Rice Watershed District;

new text begin (3) $4,150,000 is for increasing storage capacity and improving water level control at
JD 19/Nelson Slough to the Middle-Snake-Tamarac Rivers Watershed District;

new text begin (4) $3,000,000 is a for a new flood storage impoundment and gradient and flow controls
for JD 14/Lilac Ridge to the Middle-Snake-Tamarac Rivers Watershed District;

new text begin (5) $4,668,000 is for the community grant program to remove the city of Newfolden
from the 100-year floodplain to the Middle-Snake-Tamarac Rivers Watershed District;

new text begin (6) $7,000,000 is for construction of the Roseau Lake Restoration and Flood Damage
Reduction project to the Roseau River Watershed District;

new text begin (7) $1,000,000 is for permitting, plans, easement acquisition, and final design of Whitney
Lake retention sites to the Roseau River Watershed District;

new text begin (8) $13,500,000 is for final engineering, permitting, land acquisition, and construction
of Phase 1 and Phase 2 of the Klondike Clean Water Retention Project of the Two Rivers
Watershed District; and

new text begin (9) $214,000 is for property acquisition of flood-prone property in the Wild Rice
Watershed District.

new text begin (b) For the purpose of determining any local match required, the project includes all
local flood-related activities.

new text begin (c) To the extent that the cost of the project exceeds two percent of the median household
income in the municipality multiplied by the number of households in the municipality, this
appropriation is also for the local share of the project.

new text begin To provide the money appropriated in this section from the bond
proceeds fund, the commissioner of management and budget shall sell and issue bonds of
the state in an amount up to $47,057,000 in the manner, upon the terms, and with the effect
prescribed by Minnesota Statutes, sections 16A.631 to 16A.675, and by the Minnesota
Constitution, article XI, sections 4 to 7.
