A bill for an act
relating to energy; establishing a preference for purchase of a motorboat with zero
net greenhouse gas emissions; amending Minnesota Statutes 2020, section 16C.135,
by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 16C.135, is amended by adding a subdivision
to read:

new text begin Motorboat purchases. new text end

new text begin (a) When purchasing a motorboat or a replacement
power train for a central motorboat fleet or for use by an agency, the commissioner or the
agency must purchase a motorboat powered by a qualifying electric marine power train or
a qualifying electric marine power train.

new text begin (b) Paragraph (a) does not apply if the commissioner reasonably proves the motorboat
type would be incapable of carrying out the primary purpose for which the motorboat is
purchased. In order to qualify for the exemption under this paragraph, the applicable agency
commissioner must document:

new text begin (1) how a shift to electric propulsion would prohibit the motorboat type from completing
the primary purpose; and

new text begin (2) that reasonable attempts to source a qualifying electric marine power train in
combination with a more hydro-efficient or lighter-weight motorboat hull still failed to meet
the primary purpose.

new text begin (c) For purposes of this subdivision, "motorboat" has the meaning given in section
86B.005, subdivision 9.

new text begin (d) For purposes of this subdivision, "qualifying electric marine power train" means a
fully electric outboard or inboard motor with continuous power greater than 15 kilowatts
used by vessels, of which the sole source of propulsive power is the energy stored in battery
packs. Qualifying electric marine power train includes required accessories, such as throttles,
displays, and battery packs.
