A bill for an act
relating to human services; appropriating money for tribal and county
reimbursement of costs incurred due to administrative error.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin APPROPRIATION; INSTITUTIONS FOR MENTAL DISEASE
PAYMENTS.

new text begin $8,812,000 is appropriated in fiscal year 2022 from the general fund to the commissioner
of human services for reimbursing counties for the commissioner's estimated value of the
statewide county share of costs for which federal funds were claimed, but that were not
eligible for federal funding. The claims were for substance use disorder services provided
in institutions for mental disease, for claims paid between January 1, 2014, and June 30,
2019. The commissioner of human services shall allocate this appropriation between counties
in proportion to each county's estimated county share versus the estimated statewide county
share. Prior to payment of the allocated amount to a county, the county must pay in full any
unpaid consolidated chemical dependency treatment fund invoiced county share. This is a
onetime appropriation.

Sec. 2. new text begin APPROPRIATION; CHILDREN'S RESIDENTIAL FACILITIES FEDERAL
FOSTER CARE REIMBURSEMENT.

new text begin $....... is appropriated in fiscal year 2022 from the general fund to the commissioner of
human services for grants to counties, the Leech Lake Band of Ojibwe, and the White Earth
Band of Chippewa for reimbursing the value of the commissioner's estimate of the county
and tribal share of federal Title IV-E foster care reimbursement claims that have not been
paid due to children's residential facility staff noncompliance with federal enhanced
background study requirements. The commissioner of human services shall allocate grants
based on the actual amount of county and tribe costs for unpaid federal foster care
reimbursement claims between July 1, 2019, and March 1, 2020. This is a onetime
appropriation.

Sec. 3. new text begin APPROPRIATION; CASH ASSISTANCE OVERPAYMENT RECOVERY.

human services for grants to counties and tribes for reimbursing counties and tribes for costs
incurred related to repaying cash assistance program participants from whom overpayments
were collected between August 1, 2016, and November 1, 2019. The commissioner of
human services shall allocate grants based on the actual amount of county and tribe costs
incurred related to implementing and assisting with the repayment process. This is a onetime
appropriation.
