A bill for an act
relating to transportation; prohibiting the commissioner of public safety from
requiring an applicant to disclose a diagnosis of insulin-treated diabetes unless the
applicant had a driving-related episode; amending Minnesota Statutes 2020, section
171.13, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 171.13, is amended by adding a subdivision
to read:

new text begin Insulin-treated diabetes mellitus. new text end

new text begin (a) The commissioner must not require an
applicant to disclose that the applicant has been diagnosed with insulin-treated diabetes
mellitus unless the applicant has had a driving-related episode within the last four years.
For purposes of this subdivision, a "driving-related episode" is an episode that occurs while
a person is driving, operating, or in physical control of a motor vehicle and the person loses
the ability to assume and retain an upright posture without support or is unable to overcome
diabetic symptoms without the assistance of another.

subdivision 3 based solely on the fact that the person has been diagnosed with insulin-treated
diabetes mellitus.
