A bill for an act
relating to education; requiring a public school to provide transportation for
nonpublic students on each day the nonpublic student has an on-site instructional
day during the 2020-2021 school year; amending Minnesota Statutes 2018, section
123B.84.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 123B.84, is amended to read:


123B.84 POLICY.

new text begin (a) new text end In districts where the state provides aids for transportation it is in the public interest
to provide equality of treatment in transporting school children of the state who are required
to attend elementary and secondary schools pursuant to chapter 120A, so that the health,
welfare and safety of the children, while using the public highways of the state, shall be
protected.

new text begin (b) new text end School children attending any schools, complying with section 120A.22, are therefore
entitled to the same rights and privileges relating to transportation.

new text begin (c) Notwithstanding sections 123B.86, 123B.87, 123B.88, and 123B.92, for the 2020-2021
school year only, on each day that a public school district is conducting instruction, whether
on-site or through distance instruction, the public school district must transport a nonpublic
student if the nonpublic school is conducting on-site instruction on that day.

Sec. 2. new text begin PUPIL TRANSPORTATION; NONPUBLIC STUDENTS.

new text begin (a) A nonpublic school must submit to the school board of the public school district
where it is located a calendar of its on-site instructional days for the 2020-2021 school year.

new text begin (b) A public school district must transport a nonpublic student according to section 1
on any day that is reported as an on-site instructional day under paragraph (a).
