A bill for an act
relating to human services; modifying certified community behavioral health clinic
reimbursement requirements; requiring a report.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin (a) If the commissioner of human
services has not obtained federal approval for medical assistance reimbursement under
Minnesota Statutes, section 256B.0625, subdivision 5m, by October 1, 2020, the
commissioner shall reimburse any certified community behavioral health clinic (CCBHC)
provider that is ineligible for reimbursement under the federal section 223 CCBHC
demonstration with state funds, using the prospective payment rate for CCBHC services as
described in Minnesota Statutes, section 256B.0625, subdivision 5m, paragraph (b). The
commissioner shall continue to reimburse such providers with state funds until federal
approval is obtained for CCBHC services.

new text begin (b) If the federal section 223 demonstration expires before the commissioner of human
services obtains federal approval of medical assistance reimbursement for CCBHC services,
the commissioner shall pay certified CCBHC providers that received reimbursement under
the federal section 223 demonstration prior to its expiration using the prospective payment
system described in Minnesota Statutes, section 256B.0625, subdivision 5m, paragraph (b).
These payments shall be made with state funds until the commissioner obtains federal
approval of medical assistance reimbursement for CCBHC services.

new text begin (c) On October 1, 2020, the commissioner of human services shall pay CCBHC providers
using the prospective payment system as described in Minnesota Statutes, section 256B.0625,
subdivision 5m, paragraph (b), through a monthly supplemental wraparound payment until
the full prospective payment rate is programmed into the state's Medicaid Management
Information System (MMIS). The commissioner shall pay CCBHC providers the full
prospective payment through MMIS for all eligible medical assistance enrollees until the
managed care reimbursement requirement described in Laws 2020, First Special Session
chapter 2, article 2, section 12, is fully implemented.

commissioner of human services shall, upon federal approval of medical assistance
reimbursement for CCBHC services under Minnesota Statutes, section 256B.0625,
subdivision 5m, reimburse the state general fund for the federal share of the CCBHC
payments from state funds under this section, retroactive to October 1, 2020. The
commissioner shall notify the revisor of statutes and Minnesota Management and Budget
when federal approval is obtained.

shall provide a report to the chairs, cochairs, and ranking minority members of the legislative
committees having jurisdiction over health and human services updating the legislature on
the implementation of this section, including the status of the request for federal approval
of medical assistance reimbursement for CCBHC services under Minnesota Statutes, section
256B.0625, subdivision 5m.
