A bill for an act
relating to health; allowing transfer of personal identifiers in the cancer reporting
system under certain circumstances; amending Minnesota Statutes 2018, section
144.69; proposing coding for new law in Minnesota Statutes, chapter 144.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 144.69, is amended to read:


144.69 CLASSIFICATION OF DATA ON INDIVIDUALS.

Notwithstanding any law to the contrary, including section 13.05, subdivision 9, data
collected on individuals by the cancer deleted text begin surveillancedeleted text end new text begin reportingnew text end system, including the names
and personal identifiers of persons required in section 144.68 to report, shall be private and
may only be used for the purposes set forth in this section and sections 144.671, 144.672,
and 144.68. Any disclosure other than is provided for in this section and sections 144.671,
144.672, and 144.68, is declared to be a misdemeanor and punishable as such. Except as
provided by rule, and as part of an epidemiologic investigation, an officer or employee of
the commissioner of health may interview patients named in any such report, or relatives
of any such patient, only after deleted text begin the consent ofdeleted text end new text begin notifyingnew text end the attending physician or surgeon

Sec. 2.

new text begin [144.9999] TRANSFERS OF INFORMATION TO NON-MINNESOTA
STATE AND FEDERAL GOVERNMENT AGENCIES.

new text begin (a) Information containing personal identifiers collected by the cancer reporting system
may be disseminated to the statewide cancer registry of other states solely for purposes
consistent with sections 144.671, 144.672, 144.68, and 144.69, provided that the other state
agrees to maintain the classification of the information as provided under section 144.69.

new text begin (b) Information, excluding direct identifiers such as name, Social Security number,
telephone number, and street address, collected by the cancer reporting system may be
provided to the Centers for Disease Control and Prevention's National Program of Cancer
Registries and the National Cancer Institute's Surveillance, Epidemiology, and End Results
Program registry.

new text begin The revisor of statutes shall change the term "cancer surveillance system" to "cancer
reporting system" in Minnesota Statutes, sections 13.3806, subdivision 14, and 144.671.
