A bill for an act
relating to liquor; allowing licensed manufacturer of wine to sell hard cider at
on-sale or off-sale without Minnesota grown requirement; amending Minnesota
Statutes 2018, sections 340A.101, by adding a subdivision; 340A.301, subdivision
10.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 340A.101, is amended by adding a subdivision
to read:

new text begin "Hard cider" means a beverage that may contain carbonation
and flavors, produced through alcoholic fermentation of any fruit or fruit juice, consisting
of at least one-half percent but not greater than seven percent alcohol by volume and sold
or offered for sale as hard cider and not as a wine, wine product, or substitute for wine in
bottles, cases, kegs, cans, or other suitable containers of the type used for the sale of malt
liquor in this state.

Sec. 2.

Minnesota Statutes 2018, section 340A.301, subdivision 10, is amended to read:


Subd. 10.

Sales without license.

new text begin (a) new text end A licensed brewer or brew pub may without an
additional license sell malt liquor to employees or retired former employees, in amounts of
not more than 768 fluid ounces in a week for off-premise consumption only.

new text begin (b)new text end A collector of commemorative bottles, those terms are as defined in section 297G.01,
subdivisions 4 and 5, may sell them to another collector without a license. It is also lawful
for a collector of beer cans to sell unopened cans of a brand which has not been sold
commercially for at least two years to another collector without obtaining a license. The
amount sold to any one collector in any one month shall not exceed 768 fluid ounces.

new text begin (c)new text end A licensed manufacturer of wine containing not more than 25 percent alcohol by
volume nor less than 51 percent wine made from Minnesota-grown agricultural products
may sell at on-sale or off-sale wine made on the licensed premises without a further license.

new text begin (d) Notwithstanding paragraph (c), a licensed manufacturer of wine may sell at on-sale
or off-sale hard cider made on the licensed premises without a further license and without
a Minnesota grown agricultural product requirement.
