A House concurrent resolution
relating to Executive Orders 20-01 and 20-35; terminating a peacetime emergency
declaration.

WHEREAS, the State of Minnesota has faced a significant public health emergency in
confronting the outbreak of the infectious disease known as COVID-19; and

WHEREAS, the Governor declared a peacetime emergency under Minnesota Statutes, section
12.31, subdivision 2, paragraph (a), in Executive Order 20-01, and has exercised a wide range of
authority pursuant to the peacetime emergency declaration; and

WHEREAS, Minnesotans have made significant sacrifices to remain healthy, safe, and secure
during the outbreak; NOW, THEREFORE,

BE IT RESOLVED by the House of Representatives of the State of Minnesota, the Senate
concurring, that effective at 12:01 a.m. on April 15, 2020, the legislature exercises its powers under
Minnesota Statutes, section 12.31, subdivision 2, paragraph (b), to terminate the Governor's peacetime
emergency declared in Executive Order 20-01 on March 13, 2020, and extended in Executive Order
20-35 on April 13, 2020; and

BE IT FURTHER RESOLVED that, recognizing the need for a seamless transition to a
nonemergency status and to protect the health, welfare, and well being of the public, the legislature
declares: (1) Executive Orders 20-02, 20-03, 20-06, 20-07, 20-10, 20-13, 20-14, 20-16, 20-19,
20-21, 20-22, 20-23, 20-24, 20-25, 20-26, 20-27, 20-28, 20-29, 20-31, and 20-34 remain in effect
until rescinded by the legislature through subsequent passage of a concurrent resolution; (2) any
provision in Laws 2020, chapter 71 and any COVID-19 response legislation passed by the legislature
on April 14, 2020, that is dependent on a declaration of a peacetime emergency is continued; and
(3) the following response measures apply with respect to the COVID-19 outbreak: (i) the most
vulnerable Minnesotans, as defined in the Department of Health's April 10, 2020, SARS-CoV-2
modeling version 2.0, must continue to observe stay-at-home practices for ten weeks from the date
this resolution is adopted or 30 days after the date of peak deaths in Minnesota, whichever is sooner;
(ii) Minnesotans that are not included in the definition of most vulnerable must practice physical
distancing, as defined in the Department of Health's April 10, 2020, SARS-CoV-2 modeling version
2.0, for 21 days after the date of this resolution; and (iii) all Minnesotans are encouraged to comply
with social distancing guidelines; and

BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representatives is
directed to prepare an enrolled copy of this resolution, to be authenticated by his signature and
those of the Speaker of the House of Representatives, the Chair of the Senate Rules and
Administration Committee, and the Secretary of the Senate, and transmit it to the Governor of the
State of Minnesota.
