A bill for an act
relating to education; identifying open enrollment priorities; amending Minnesota
Statutes 2014, section 124D.03, subdivision 5a.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2014, section 124D.03, subdivision 5a, is amended to
read:
If a school district has more applications than available seats at
a specific grade level, it must hold an impartial lottery following the January 15 deadline
to determine which students will receive seats.new text begin The district must give priority to enrolling:

new text begin (2) students whosenew text end applications new text begin are new text end related to an approved integration and

(3) students residing in that part of a municipality, defined under section 469.1812,
subdivision 3, where:

(i) the student's resident district does not operate a school building;

new text begin
(ii) the nonresident district in which the student seeks to enroll operates one or more
school buildings within the municipality; and

new text begin (iii) no other nonresident district operates a school building within the municipality. new text end
The process for the school district lottery must be established in school district policy,
approved by the school board, and posted on the school district's Web site.

This section is effective for lotteries conducted beginning
July 1, 2016.
