A bill for an act
relating to military officers; providing for reimbursement grants to local units
of government for public safety personnel on authorized leave; amending
Minnesota Statutes 2012, sections 190.16, by adding a subdivision; 192.26, by
adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 190.16, is amended by adding a
subdivision to read:

reimbursement grant program under section 192.26, subdivision 3, and pay grants to local
units of government to reimburse them for additional costs to replace the services of
employees on authorized leave under section 192.26, subdivision 1.

Sec. 2.

Minnesota Statutes 2012, section 192.26, is amended by adding a subdivision
to read:

new text begin (a) For purposes of
this subdivision, the terms in this paragraph have the meanings given them.

new text begin (1) "Public safety employees" means peace officers, firefighters, and ambulance
service personnel, as defined in section 144E.001, subdivision 3a, that are full-time
employees of a local unit of government.

new text begin (2) "Local unit of government" means a county or home rule charter or statutory city.

new text begin (3) "Replacement costs" means the wages or salaries and benefit costs incurred by
the local unit of government to replace the services of employees on authorized leave
under this section. Replacement costs include the costs of (i) full-time employees hired to
perform those services, including wages on salaries, federal and state employer payments,
and benefits, and (ii) any additional costs, such as overtime pay, paid to permanent
full-time employees who provide services in addition to their ordinary duties to replace
the services of an employee on authorized leave.

new text begin (4) "Full-time employees" means employees who are considered full time under the
personnel provisions of the local unit of government, but who are scheduled to work at
least 35 hours per week.

new text begin (b) The adjutant general shall make grants to local units of government to reimburse
them for the replacement costs of providing the services performed by public safety
employees on authorized leave under this section.

new text begin (c) To be eligible for state reimbursement of the amount of replacement costs paid
for the preceding calendar year as determined under this subdivision, the governmental
subdivision shall apply to the adjutant general by March 15. By July 15, the adjutant
general shall pay the reimbursement grants to the local units of government.

new text begin (d) The adjutant general shall prescribe the form and supporting information that
must be supplied by the local unit of government as part of the application for state
reimbursement.

new text begin (e) An appropriation by law from the general fund to the adjutant general must be
used to pay the grants. If the appropriation is insufficient to pay the entire sum of all of the
grants, the adjutant general shall reduce each grant proportionally so that the sum of the
grants equals the available appropriation.

local units of government in calendar year 2013 and calendar years thereafter.
