A bill for an act
relating to education finance; clarifying that a school district is not required to
provide educational services to students without disabilities from other states;
amending Minnesota Statutes 2010, section 125A.515, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 125A.515, is amended by adding a
subdivision to read:

new text begin Students without a disability from other states. new text end

new text begin A school district is not
required to provide education services under this section to a student who:

new text begin (1) is not a resident of Minnesota;
new text end

new text begin (2) does not have an individualized education program; and
new text end

new text begin (3) does not have a tuition arrangement or agreement to pay the cost of education
from the placing authority.

new text begin This section is effective July 1, 2011, for fiscal years 2012
and later.
