  1.2             relating to public safety; providing for property 
  1.3             manager background checks on the Minnesota 
  1.4             computerized criminal history system; amending 
  1.5             Minnesota Statutes 2002, section 299C.68, subdivision 
  1.6             5. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 299C.68, 
  1.9   subdivision 5, is amended to read: 
  1.10     Subd. 5.  [RESPONSE OF BUREAU.] The superintendent shall 
  1.11  respond in writing to a background check request within a 
  1.12  reasonable time not to exceed ten working days after receiving 
  1.13  the signed form under subdivision 3.  The superintendent's 
  1.14  response from the search of the Minnesota computerized criminal 
  1.15  history system must clearly indicate whether the manager has 
  1.16  ever been convicted of a background check crime and, if so, a 
  1.17  description of the crime, date and jurisdiction of the 
  1.18  conviction, and date of discharge of sentence.  If a search is 
  1.19  being done of the national criminal records repository, the 
  1.20  superintendent shall determine eligibility based upon national 
  1.21  records received.  The superintendent shall reply to the owner 
  1.22  in writing indicating whether the manager is or is not eligible 
  1.23  for employment.  The superintendent's response must clearly 
  1.24  indicate whether the manager has ever been convicted of a 
  1.25  background check crime and, if so, a description of the crime, 
  1.26  date and jurisdiction of conviction, and date of discharge of 
  2.1   the sentence. 
  2.2      [EFFECTIVE DATE.] This section is effective the day 
  2.3   following final enactment.
