  1.2             relating to game and fish; creating a mourning dove 
  1.3             hunting season; requiring a report; appropriating 
  1.4             money; amending Minnesota Statutes 2002, sections 
  1.5             97A.015, subdivision 24; 97A.045, subdivision 7; 
  1.6             97A.075, by adding a subdivision; 97A.411, subdivision 
  1.7             2; 97A.475, subdivision 5, as amended; proposing 
  1.8             coding for new law in Minnesota Statutes, chapter 97B; 
  1.9             repealing Minnesota Statutes 2002, section 97B.731, 
  1.10            subdivision 2. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  Minnesota Statutes 2002, section 97A.015, 
  1.13  subdivision 24, is amended to read: 
  1.14     Subd. 24.  [GAME BIRDS.] "Game birds" means migratory 
  1.15  waterfowl, pheasant, ruffed grouse, sharp-tailed grouse, Canada 
  1.16  spruce grouse, prairie chickens, gray partridge, bob-white 
  1.17  quail, turkeys, coots, gallinules, sora and Virginia rails, 
  1.18  American woodcock, and common snipe, and mourning doves. 
  1.19     [EFFECTIVE DATE.] This section is effective the day 
  1.20  following final enactment. 
  1.21     Sec. 2.  Minnesota Statutes 2002, section 97A.045, 
  1.22  subdivision 7, is amended to read: 
  1.23     Subd. 7.  [DUTY TO ENCOURAGE STAMP DESIGN AND PURCHASES.] 
  1.24  (a) The commissioner shall encourage the purchase of: 
  1.25     (1) Minnesota migratory waterfowl stamps by nonhunters 
  1.26  interested in migratory waterfowl preservation and habitat 
  1.27  development; 
  1.28     (2) pheasant stamps by persons interested in pheasant 
  2.1   habitat improvement; 
  2.2      (3) trout and salmon stamps by persons interested in trout 
  2.3   and salmon stream and lake improvement; and 
  2.4      (4) turkey stamps by persons interested in wild turkey 
  2.5   management and habitat improvement; and 
  2.6      (5) mourning dove stamps by persons interested in dove 
  2.7   management and habitat improvement.  
  2.8      (b) The commissioner shall make rules governing contests 
  2.9   for selecting a design for each stamp, including those stamps 
  2.10  not required to be in possession while taking game or fish. 
  2.11     [EFFECTIVE DATE.] This section is effective the day 
  2.12  following final enactment. 
  2.13     Sec. 3.  Minnesota Statutes 2002, section 97A.075, is 
  2.14  amended by adding a subdivision to read: 
  2.15     Subd. 6.  [MOURNING DOVE STAMPS.] (a) 90 percent of revenue 
  2.16  from mourning dove stamps must be credited to the mourning dove 
  2.17  habitat improvement account.  Money in the account may be used 
  2.18  only for: 
  2.19     (1) the development, restoration, and maintenance of 
  2.20  suitable habitat for mourning doves on public and private land 
  2.21  including establishment of nesting cover and reliable food 
  2.22  sources; 
  2.23     (2) acquisitions of, or easements on, mourning dove 
  2.24  habitat; 
  2.25     (3) reimbursement of expenditures to provide mourning dove 
  2.26  habitat on public and private land; and 
  2.27     (4) the promotion of mourning dove habitat development and 
  2.28  maintenance, population surveys and monitoring, and research. 
  2.29     (b) Money in the account may not be used for: 
  2.30     (1) costs unless they are directly related to a specific 
  2.31  parcel of land under paragraph (a), clauses (1) to (3), or to 
  2.32  specific promotional or evaluative activities under paragraph 
  2.33  (a), clause (4); or 
  2.34     (2) any permanent personnel costs.  
  2.35     [EFFECTIVE DATE.] This section is effective the day 
  2.36  following final enactment. 
  3.1      Sec. 4.  Minnesota Statutes 2002, section 97A.411, 
  3.2   subdivision 2, is amended to read: 
  3.3      Subd. 2.  [SIGNATURE ON STAMPS.] A migratory waterfowl, 
  3.4   mourning dove, or pheasant stamp issued under the game and fish 
  3.5   laws must be signed by the licensee across the front of the 
  3.6   stamp to be valid. 
  3.7      [EFFECTIVE DATE.] This section is effective the day 
  3.8   following final enactment. 
  3.9      Sec. 5.  Minnesota Statutes 2002, section 97A.475, 
  3.10  subdivision 5, as amended by Laws 2003, chapter 128, article 1, 
  3.11  section 61, is amended to read: 
  3.12     Subd. 5.  [HUNTING STAMPS.] Fees for the following stamps 
  3.13  and stamp validations are: 
  3.14     (1) migratory waterfowl stamp, $7.50; 
  3.15     (2) pheasant stamp, $7.50; and 
  3.16     (3) turkey stamp validation, $5; and 
  3.17     (4) mourning dove stamp, $7.50.  
  3.18     [EFFECTIVE DATE.] This section is effective the day 
  3.19  following final enactment. 
  3.20     Sec. 6.  [97B.717] [MOURNING DOVES.] 
  3.21     Subdivision 1.  [SEASON.] The commissioner shall prescribe 
  3.22  an open season for taking mourning doves. 
  3.23     Subd. 2.  [LICENSE AND STAMP REQUIRED.] A person may not 
  3.24  take mourning doves without a small game license and a mourning 
  3.25  dove stamp in possession. 
  3.26     [EFFECTIVE DATE.] This section is effective the day 
  3.27  following final enactment. 
  3.28     Sec. 7.  [REPORT.] 
  3.29     The commissioner of natural resources shall report to the 
  3.30  legislature by August 1, 2004, on the results of the mourning 
  3.31  dove season authorized by Minnesota Statutes, section 97B.717.  
  3.32  The report must include a description of the impact of the 
  3.33  season on the mourning dove population in the state. 
  3.34     Sec. 8.  [REPEALER.] 
  3.35     Minnesota Statutes 2002, section 97B.731, subdivision 2, is 
  3.36  repealed effective the day following final enactment. 
  4.1      Sec. 9.  [APPROPRIATION.] 
  4.2      $324,000 in fiscal year 2004 and $324,000 in fiscal year 
  4.3   2005 are from the mourning dove habitat improvement account for 
  4.4   only the purposes specified in Minnesota Statutes, section 
  4.5   97A.075, subdivision 6.
