  1.1                          A bill for an act 
  1.2             relating to human services; clarifying medical 
  1.3             assistance coverage for skilled nursing facility 
  1.4             services; providing for collaborative service models; 
  1.5             amending Minnesota Statutes 2002, section 256B.0625, 
  1.6             by adding a subdivision; Minnesota Statutes 2003 
  1.7             Supplement, section 256B.69, subdivision 6b. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 256B.0625, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 2a.  [SKILLED NURSING FACILITY AND HOSPICE SERVICES 
  1.12  FOR DUAL ELIGIBLES.] Medical assistance covers skilled nursing 
  1.13  facility services for individuals eligible for both medical 
  1.14  assistance and Medicare who have waived the Medicare skilled 
  1.15  nursing facility room and board benefit and have enrolled in the 
  1.16  Medicare hospice program.  Medical assistance covers skilled 
  1.17  nursing facility services regardless of whether an individual 
  1.18  enrolled in the Medicare hospice program prior to, on, or after 
  1.19  the date of the hospitalization that qualified the individual 
  1.20  for Medicare skilled nursing facility services. 
  1.21     Sec. 2.  Minnesota Statutes 2003 Supplement, section 
  1.22  256B.69, subdivision 6b, is amended to read: 
  1.23     Subd. 6b.  [HOME AND COMMUNITY-BASED WAIVER SERVICES.] (a) 
  1.24  For individuals enrolled in the Minnesota senior health options 
  1.25  project authorized under subdivision 23, elderly waiver services 
  1.26  shall be covered according to the terms and conditions of the 
  2.1   federal agreement governing that demonstration project. 
  2.2      (b) For individuals under age 65 enrolled in demonstrations 
  2.3   authorized under subdivision 23, home and community-based waiver 
  2.4   services shall be covered according to the terms and conditions 
  2.5   of the federal agreement governing that demonstration project. 
  2.6      (c) The commissioner of human services shall issue requests 
  2.7   for proposals for collaborative service models between counties 
  2.8   and managed care organizations to integrate the home and 
  2.9   community-based elderly waiver services and additional nursing 
  2.10  home services into the prepaid medical assistance program. 
  2.11     (d) Notwithstanding Minnesota Rules, part 9500.1457, 
  2.12  subpart 1, item C, elderly waiver services shall be covered 
  2.13  statewide no sooner than July 1, 2006, under the prepaid medical 
  2.14  assistance program for all individuals who are eligible 
  2.15  according to section 256B.0915.  The commissioner may develop a 
  2.16  schedule to phase in implementation of these waiver services, 
  2.17  including collaborative service models under paragraph (c).  The 
  2.18  commissioner shall phase in implementation beginning with those 
  2.19  counties participating under section 256B.692, and those 
  2.20  counties where a viable collaborative service model has been 
  2.21  developed.  In consultation with counties and all managed care 
  2.22  organizations that have expressed an interest in participating 
  2.23  in collaborative service models, the commissioner shall evaluate 
  2.24  the models.  The commissioner shall consider the evaluation in 
  2.25  selecting the most appropriate models for statewide 
  2.26  implementation.
