  1.4             municipal newsletter subscriber data; amending 
  1.5             Minnesota Statutes 2002, section 13.685; proposing 
  1.6             coding for new law in Minnesota Statutes, chapter 13. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [13.203] [MUNICIPAL ELECTRONIC NEWSLETTER 
  1.9   SUBSCRIPTION DATA.] 
  1.10     Data that identify a subscriber to a municipal electronic 
  1.11  newsletter or that identify an individual subscriber's account 
  1.12  or subscription interests are private data on individuals. 
  1.13     Sec. 2.  Minnesota Statutes 2002, section 13.685, is 
  1.14  amended to read: 
  1.15     13.685 [MUNICIPAL UTILITY CUSTOMER DATA.] 
  1.16     Data on customers of municipal electric utilities are 
  1.17  private data on individuals or nonpublic data, but may be 
  1.18  released to: 
  1.19     (1) a law enforcement agency that requests access to the 
  1.20  data in connection with an investigation; 
  1.21     (2) a school for purposes of compiling pupil census data; 
  1.22     (3) the Metropolitan Council for use in studies or analyses 
  1.23  required by law; 
  1.24     (4) a public child support authority for purposes of 
  1.25  establishing or enforcing child support; or 
  1.26     (5) a person where use of the data directly advances the 
  2.1   general welfare, health, or safety of the public; the 
  2.2   commissioner of administration may issue advisory opinions 
  2.3   construing this clause pursuant to section 13.072.
