  1.1                          A bill for an act 
  1.2             relating to human services; modifying child care 
  1.3             center licensing fees; amending Minnesota Statutes 
  1.4             2003 Supplement, section 245A.10, subdivision 4. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2003 Supplement, section 
  1.7   245A.10, subdivision 4, is amended to read: 
  1.8      Subd. 4.  [ANNUAL LICENSE OR CERTIFICATION FEE FOR PROGRAMS 
  1.9   WITH LICENSED CAPACITY.] (a) Child care centers and programs 
  1.10  with a licensed capacity shall pay an annual nonrefundable 
  1.11  license or certification fee based on the following schedule:

  1.25     (b) A day training and habilitation program serving persons 
  2.1   with developmental disabilities or related conditions shall be 
  2.2   assessed a license fee based on the schedule in paragraph (a) 
  2.3   unless the license holder serves more than 50 percent of the 
  2.4   same persons at two or more locations in the community.  When a 
  2.5   day training and habilitation program serves more than 50 
  2.6   percent of the same persons in two or more locations in a 
  2.7   community, the day training and habilitation program shall pay a 
  2.8   license fee based on the licensed capacity of the largest 
  2.9   facility and the other facility or facilities shall be charged a 
  2.10  license fee based on a licensed capacity of a residential 
  2.11  program serving one to 24 persons.
