  1.1                          A bill for an act 
  1.2             relating to transportation; authorizing state bonds 
  1.3             for highway purposes; appropriating money. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [HIGHWAY AND TRANSIT APPROPRIATIONS.] 
  1.6      Subdivision 1.  [TRUNK HIGHWAY PROJECTS FINANCED BY STATE 
  1.7   BONDS.] (a) $550,000,000 is appropriated from the bond proceeds 
  1.8   account in the trunk highway fund to the commissioner of 
  1.9   transportation for the actual construction, reconstruction, and 
  1.10  improvement of trunk highways that provide congestion relief, 
  1.11  added capacity, or increased mobility through bottleneck removal 
  1.12  or that improve interregional corridors.  This includes the cost 
  1.13  of actual payment to landowners for lands acquired for highway 
  1.14  rights-of-way, payment to lessees, interest subsidies, and 
  1.15  relocation expenses. 
  1.16     (b) The commissioner of transportation may use up to 
  1.17  $93,500,000 of this appropriation for program delivery. 
  1.18     (c) The commissioner shall use $50,000,000 of this 
  1.19  appropriation for accelerating transit capital improvements on 
  1.20  trunk highways such as shoulder bus lanes, bus park-and-ride 
  1.21  facilities, and ramp meter-bypass facilities. 
  1.22     Subd. 2.  [TRUNK HIGHWAY CONSTRUCTION.] (a) $25,000,000 in 
  1.23  fiscal year 2004 and $25,000,000 in fiscal year 2005 is 
  1.24  appropriated from the trunk highway fund to the commissioner of 
  2.1   transportation for improving safety and preserving the condition 
  2.2   of the trunk highway system.  This is a base appropriation. 
  2.3      (b) The commissioner may add this appropriation to any 
  2.4   appropriation made for infrastructure investment and planning.  
  2.5   Of this appropriation, $20,750,000 each year may be added to any 
  2.6   other appropriation made for state road construction.  
  2.7      Subd. 3.  [BOND SALE EXPENSES.] $550,000 is appropriated 
  2.8   from the bond proceeds account in the trunk highway fund to the 
  2.9   commissioner of finance for bond sale expenses under Minnesota 
  2.10  Statutes, section 16A.641, subdivision 8.  
  2.11     Subd. 4.  [ANTILAPSE.] Notwithstanding other law to the 
  2.12  contrary, the appropriations in this section do not cancel until 
  2.13  February 1, 2013. 
  2.14     Sec. 2.  [BOND SALE.] 
  2.15     To provide the money appropriated in section 1, 
  2.16  subdivisions 1 and 3, from the bond proceeds account in the 
  2.17  trunk highway fund, the commissioner of finance shall sell and 
  2.18  issue bonds of the state in an amount up to $550,550,000 in the 
  2.19  manner, on the terms, and with the effect prescribed by 
  2.20  Minnesota Statutes, sections 167.50 to 167.52, and by the 
  2.21  Minnesota Constitution, article XIV, section 11, at the times 
  2.22  and in the amounts requested by the commissioner of 
  2.23  transportation.  The proceeds of the bonds, except accrued 
  2.24  interest and any premium received from the sale of the bonds, 
  2.25  must be deposited in the bond proceeds account in the trunk 
  2.26  highway fund. 
  2.27     Sec. 3.  [EFFECTIVE DATE.] 
  2.28     Sections 1 and 2 are effective the day following final 
  2.29  enactment.
