  1.1                          A bill for an act 
  1.2             relating to crime prevention; requiring a study on 
  1.3             electronic alcohol monitoring. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [ELECTRONIC ALCOHOL MONITORING STUDY AND 
  1.6   REPORT.] 
  1.7      (a) The commissioner of corrections shall conduct a study 
  1.8   to determine and compare the recidivism rates of DWI offenders 
  1.9   who are subject to electronic alcohol monitoring with those who 
  1.10  are not.  In addition, the study must determine and compare the 
  1.11  pretrial conditional release violation rates for DWI offenders 
  1.12  subject to this type of monitoring with those who are not. 
  1.13     (b) The study's determinations and comparisons must be 
  1.14  assessed and evaluated using standard statistical methodology.  
  1.15  To the extent possible, the characteristics and performance of 
  1.16  the program participants must be compared with the 
  1.17  characteristics and performance of one or more control groups of 
  1.18  similar impaired driving offenders.  Control variables for this 
  1.19  analysis must include, but are not limited to, the following 
  1.20  factors: 
  1.21     (1) the offense level as measured by the number of prior 
  1.22  impaired driving violations on record; 
  1.23     (2) the date of the offense and the length of the follow-up 
  1.24  measurement period; 
  2.1      (3) the length of any incarceration following conviction 
  2.2   for the offense; and 
  2.3      (4) the length of time that offenders had been under 
  2.4   electronic alcohol monitoring. 
  2.5   The study must also determine whether the impaired driving 
  2.6   recidivism, if any, occurred during or following the period of 
  2.7   electronic alcohol monitoring, and whether it occurred pretrial 
  2.8   or following conviction. 
  2.9      (c) By February 15, 2002, the commissioner shall report the 
  2.10  results of the study to the chairs and members of the senate and 
  2.11  house committees and divisions having jurisdiction over impaired 
  2.12  driving policy and funding.
