  1.1                          A bill for an act 
  1.2             relating to state employment; permitting retired state 
  1.3             employees to purchase group long-term care insurance 
  1.4             through the same plan offered to active state 
  1.5             employees; amending Minnesota Statutes 2000, section 
  1.6             43A.318, subdivision 1. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 43A.318, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [DEFINITIONS.] (a)  [SCOPE.] For the 
  1.11  purposes of this section, the terms defined have the meaning 
  1.12  given them. 
  1.13     (b)  [ADVISORY COMMITTEE; COMMITTEE.] "Advisory committee" 
  1.14  or "committee" means the committee created under subdivision 3. 
  1.15     (c)  [COMMITTEE MEMBER; MEMBER.] "Committee member" or 
  1.16  "member" means a person serving on the advisory committee 
  1.17  created under subdivision 3. 
  1.18     (d)  [ELIGIBLE PERSON.] "Eligible person" means: 
  1.19     (1) an active member of a public pension plan of the state 
  1.20  a person who is eligible for insurance and benefits under 
  1.21  section 43A.24; 
  1.22     (2) an employee or elected official of the state who is not 
  1.23  eligible for participation in a public employee pension plan of 
  1.24  the state a person who at the time of separation from employment 
  1.25  was eligible to purchase coverage at personal expense under 
  1.26  section 43A.27, subdivision 3, regardless of whether the person 
  2.1   elected to purchase this coverage; or 
  2.2      (3) a spouse or parent of a person described in clause (1) 
  2.3   or (2), regardless of the enrollment status in the program of 
  2.4   the person described in clause (1) or (2).; or 
  2.5      (4) a parent of a person described in clause (1), 
  2.6   regardless of the enrollment status in the program of the person 
  2.7   described in clause (1). 
  2.8      (e)  [PROGRAM.] "Program" means the statewide public 
  2.9   employees long-term care insurance program created under 
  2.10  subdivision 2. 
  2.11     (f)  [PUBLIC EMPLOYEE PENSION PLAN.] "Public employee 
  2.12  pension plan" means any Minnesota public pension plan or fund 
  2.13  that provides pension or retirement coverage for state employees.
  2.14     (g)  [QUALIFIED VENDOR.] "Qualified vendor" means an entity 
  2.15  licensed or authorized to underwrite, provide, or administer 
  2.16  group long-term care insurance benefits in this state. 
  2.17     Sec. 2.  [EFFECTIVE DATE.] 
  2.18     Section 1 is effective the day following final enactment 
  2.19  and applies to all persons who separated from employment prior 
  2.20  to the day following final enactment and their spouses.
