1.1 A bill for an act 1.2 relating to public safety; modifying training 1.3 requirements that the rules of the board of private 1.4 detective and protective agent services must address; 1.5 amending Minnesota Statutes 2000, sections 326.32, 1.6 subdivision 1a, by adding a subdivision; 326.3361, 1.7 subdivisions 1, 2. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 2000, section 326.32, 1.10 subdivision 1a, is amended to read: 1.11 Subd. 1a. [ARMED WITH A FIREARM.] An individual 1.12 is "armedemployeewith a firearm"means an employee of a1.13private detective or protective agent whoif at any time in the 1.14 performance of theemployee'sindividual's duties the individual 1.15 wears, carries, possesses, or has access to a firearm. 1.16 Sec. 2. Minnesota Statutes 2000, section 326.32, is 1.17 amended by adding a subdivision to read: 1.18 Subd. 1b. [ARMED WITH A WEAPON.] An individual is "armed 1.19 with a weapon" if at any time in the performance of the 1.20 individual's duties the individual wears, carries, possesses, or 1.21 has access to: 1.22 (1) a weapon other than a firearm; or 1.23 (2) an immobilizing or restraining device. 1.24 Sec. 3. Minnesota Statutes 2000, section 326.3361, 1.25 subdivision 1, is amended to read: 1.26 Subdivision 1. [RULES.] The board shall, by rule, 2.1 prescribe the requirements, duration, contents, and standards 2.2 for successful completion of certified training programs for 2.3 license holders, qualified representatives, Minnesota managers, 2.4 partners, and employees, including: 2.5 (1)first aid and firearms training required for armed2.6employees, including training in the legal limitations on the2.7justifiable use of force and deadly force as specified in2.8sections 609.06 and 609.065for those individuals who are armed 2.9 with a firearm, training in the proper use of, and the risks and 2.10 dangers arising from the use of, firearms; 2.11 (2)risks and dangers arising fromfor those individuals 2.12 who are armed with a weapon, training in the proper use of, and 2.13 the risks and dangers arising from the use of, weapons other 2.14 than firearms, including, but not limited to, bludgeons, 2.15 nightsticks, batons, chemical weapons, and electronic 2.16 incapacitation devices, and restraint or immobilization 2.17 techniques; 2.18 (3) for those individuals who are armed with a firearm or 2.19 armed with a weapon, training in first aid and alternatives to 2.20 the use of force, including advantages to not using force and 2.21 specifically when force should not be used; 2.22 (4) for those individuals who are armed with a firearm or 2.23 armed with a weapon, training in the legal limitations on the 2.24 justifiable use of force and deadly force as specified in 2.25 sections 609.06 and 609.065; 2.26(4)(5) standards for weapons and equipment issued to or 2.27 carried or used bylicense holders, qualified representatives,2.28Minnesota managers, partners, and employeesthose individuals; 2.29(5)(6) preassignment or on-the-job training, or its 2.30 equivalent, required before applicants may be certified as 2.31 having completed training; and 2.32(6)(7) continuing training for license holders, qualified 2.33 representatives, Minnesota managers, partners, employees,and2.34armed employeesindividuals armed with a firearm, and 2.35 individuals armed with a weapon. 2.36 Sec. 4. Minnesota Statutes 2000, section 326.3361, 3.1 subdivision 2, is amended to read: 3.2 Subd. 2. [REQUIRED CONTENTS.] The rules adopted by the 3.3 board must require: 3.4 (1) 12 hours of preassignment or on-the-job certified 3.5 training within the first 21 days of employment, or evidence 3.6 that the employee has successfully completed equivalent training 3.7 before the start of employment; 3.8 (2) certification by the board of completion of certified 3.9 training for a license holder, qualified representative, 3.10 Minnesota manager, partner, and employee to carry or use a 3.11 firearm, a weapon other than a firearm, or an immobilizing or 3.12 restraint technique; and 3.13 (3) six hours a year of certified continuing training for 3.14 all license holders, qualified representatives, Minnesota 3.15 managers, partners, and employees, and an additional six hours a 3.16 year forarmedindividuals who are armed with firearms or armed 3.17 with weapons, which must include annual certification of 3.18 thearmedindividual. 3.19 Anemployeeindividual may not carry or use a weapon while 3.20 undergoing on-the-job training under this subdivision.
