  1.1                          A bill for an act 
  1.2             relating to insurance; no-fault auto; regulating 
  1.3             income loss benefits to senior citizens; amending 
  1.4             Minnesota Statutes 2000, section 65B.491. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 65B.491, is 
  1.7   amended to read: 
  1.8      65B.491 [SENIOR CITIZENS.] 
  1.9      After August 1, 1987, no A plan of reparation security 
  1.10  issued to or renewed with a person who has attained the age of 
  1.11  65 years may must provide coverage for wage disability and 
  1.12  income loss reimbursement that benefits under section 65B.44, 
  1.13  subdivision 3, unless the insured will not reasonably be 
  1.14  expected to be able to receive elects not to have this 
  1.15  coverage.  It is the responsibility of the person issuing or 
  1.16  renewing the plan to inquire as to the applicability of this 
  1.17  section whether the insured wishes to have this coverage.  The 
  1.18  reparation obligor may satisfy this responsibility by sending an 
  1.19  inquiry by first class mail, not less than 30 days prior to each 
  1.20  renewal period after the insured has attained the age of 65.  
  1.21  This inquiry sent by mail must contain a notice of the discount 
  1.22  for not having disability and income loss coverage, a 
  1.23  preaddressed postage paid reply form, and instructions to reply 
  1.24  only if the insured does not wish to have this coverage in the 
  1.25  next renewal period.  If the insured responds that the insured 
  2.1   does wish to have this coverage, or if the reparation obligor 
  2.2   does not receive a response from the insured within 15 days of 
  2.3   the date of mailing to the insured, disability and income loss 
  2.4   coverage must continue to be provided under section 65B.44, 
  2.5   subdivision 3.  The rate for any plan for which coverage has 
  2.6   been excluded or reduced pursuant to this section must be 
  2.7   reduced accordingly.  This section does apply to self-insurance. 
  2.8      Sec. 2.  [REVISOR INSTRUCTION.] 
  2.9      The revisor of statutes shall recode Minnesota Statutes 
  2.10  2000, section 65B.491, as section 65B.44, subdivision 3a.
