  1.1                          A bill for an act 
  1.2             relating to commerce; prohibiting body piercing 
  1.3             services for a person under 18 without parental 
  1.4             consent; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 325F. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [325F.814] [BODY PIERCING.] 
  1.8      Subdivision 1.  [PROHIBITION.] No person may provide body 
  1.9   piercing services for a person under the age of 18 without 
  1.10  written parental consent to the services.  The consent must 
  1.11  include both the custodial and noncustodial parents where 
  1.12  applicable. 
  1.13     Subd. 2.  [DEFINITION.] For the purposes of this section, 
  1.14  "body piercing" means the perforation of any human body part 
  1.15  other than an earlobe for the purpose of inserting jewelry or 
  1.16  other decoration or for some other nonmedical purpose. 
  1.17     Subd. 3.  [PENALTIES.] (a) A person who violates 
  1.18  subdivision 1 is guilty of a misdemeanor. 
  1.19     (b) The public and private remedies in section 8.31 apply 
  1.20  to violations of this section.
