  1.1                          A bill for an act 
  1.2             relating to state government; rejecting certain labor 
  1.3             agreements; modifying and ratifying certain 
  1.4             compensation plans; ratifying a labor agreement. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [CONTRACTS AND PLANS.] 
  1.7      Subdivision 1.  [COUNCIL 6.] The labor agreement between 
  1.8   the state of Minnesota and the American federation of state, 
  1.9   county, and municipal employees, units 2, 3, 4, 6, and 7, 
  1.10  submitted to the legislative coordinating commission 
  1.11  subcommittee on employee relations on November 21, 2001, and 
  1.12  implemented after 30 days as provided in Minnesota Statutes, 
  1.13  section 3.855, subdivision 2, paragraph (c), is rejected. 
  1.14     Subd. 2.  [PROFESSIONAL EMPLOYEES.] The labor agreement 
  1.15  between the state of Minnesota and the Minnesota association of 
  1.16  professional employees, submitted to the legislative 
  1.17  coordinating commission subcommittee on employee relations on 
  1.18  November 21, 2001, and implemented after 30 days as provided in 
  1.19  Minnesota Statutes, section 3.855, subdivision 2, paragraph (c), 
  1.20  is rejected. 
  1.21     Subd. 3.  [UNREPRESENTED MANAGERS; MINNESOTA STATE COLLEGES 
  1.22  AND UNIVERSITIES.] The amendments to the compensation plan for 
  1.23  administrators of the Minnesota state colleges and universities, 
  1.24  approved by the legislative coordinating commission subcommittee 
  1.25  on employee relations on December 11, 2001, are ratified. 
  2.1      Subd. 4.  [MANAGERIAL PLAN.] The amendments to the 
  2.2   managerial plan, approved by the legislative coordinating 
  2.3   commission subcommittee on employee relations on December 11, 
  2.4   2001, are modified to remove all provisions granting insurance 
  2.5   benefits to a domestic partner of a state employee, and as 
  2.6   modified, the amendments to the plan are ratified. 
  2.7      Subd. 5.  [COMMISSIONER'S PLAN.] The amendments to the 
  2.8   commissioner's plan, approved by the legislative coordinating 
  2.9   commission subcommittee on employee relations on December 11, 
  2.10  2001, are modified to remove all provisions granting insurance 
  2.11  benefits to a domestic partner of a state employee, and as 
  2.12  modified, the amendments to the plan are ratified.  
  2.13     Subd. 6.  [SUPERVISORS.] The labor agreement between the 
  2.14  state of Minnesota and the middle management association, 
  2.15  submitted to the legislative coordinating commission 
  2.16  subcommittee on employee relations on December 21, 2001, and 
  2.17  implemented after 30 days as provided in Minnesota Statutes, 
  2.18  section 3.855, subdivision 2, paragraph (c), is rejected. 
  2.19     Subd. 7.  [RESIDENTIAL SCHOOLS TEACHERS.] The labor 
  2.20  agreement between the state of Minnesota and the state 
  2.21  residential schools education association, submitted to the 
  2.22  legislative coordinating commission subcommittee on employee 
  2.23  relations on December 21, 2001, and implemented after 30 days as 
  2.24  provided in Minnesota Statutes, section 3.855, subdivision 2, 
  2.25  paragraph (c), is rejected. 
  2.26     Subd. 8.  [ADMINISTRATIVE AND SERVICE FACULTY.] The labor 
  2.27  agreement between the state of Minnesota and the Minnesota state 
  2.28  university association of administrative and service faculty, 
  2.29  submitted to the legislative coordinating commission 
  2.30  subcommittee on employee relations on December 28, 2001, and 
  2.31  implemented after 30 days as provided in Minnesota Statutes, 
  2.32  section 3.855, subdivision 2, paragraph (c), is rejected. 
  2.33     Subd. 9.  [MNSCU MANAGERS.] The amendments to the 
  2.34  compensation plan for administrators of the Minnesota state 
  2.35  colleges and universities, as modified and approved by the 
  2.36  legislative coordinating commission subcommittee on employee 
  3.1   relations on February 1, 2002, are ratified. 
  3.2      Sec. 2.  [RATIFICATION.] 
  3.3      The labor agreement between the state of Minnesota and the 
  3.4   Minnesota government engineers council, approved by the 
  3.5   legislative coordinating commission subcommittee on employee 
  3.6   relations on December 11, 2001, is ratified. 
  3.7      Sec. 3.  [COVERAGE.] 
  3.8      As provided under Minnesota Statutes, section 43A.18, 
  3.9   subdivision 2, an executive branch state employee is covered by 
  3.10  the plan established under that subdivision if the employee is 
  3.11  not covered by a collective bargaining agreement because the 
  3.12  proposed agreement that would cover the employee is rejected by 
  3.13  the legislature, or because the legislature adjourns without 
  3.14  ratifying the proposed agreement. 
  3.15     Sec. 4.  [EFFECTIVE DATE.] 
  3.16     Sections 1 to 3 are effective the day following final 
  3.17  enactment.
