  1.1                          A bill for an act 
  1.2             relating to education; clarifying advanced placement 
  1.3             and international baccalaureate program provisions; 
  1.4             appropriating money; amending Minnesota Statutes 2000, 
  1.5             section 120B.13, subdivisions 1, 2.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 120B.13, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [PROGRAM STRUCTURE; TRAINING PROGRAMS FOR 
  1.10  TEACHERS.] (a) The advanced placement and international 
  1.11  baccalaureate programs are well-established academic programs 
  1.12  for mature, academically-directed high school students.  These 
  1.13  programs, in addition to providing academic rigor, offer sound 
  1.14  curricular design, accountability, comprehensive external 
  1.15  assessment, feedback to students and teachers, and the 
  1.16  opportunity for high school students to compete academically on 
  1.17  a global level.  Advanced placement and international 
  1.18  baccalaureate programs allow students to leave high school with 
  1.19  the academic skills and self-confidence to succeed in college 
  1.20  and beyond.  The advanced placement and international 
  1.21  baccalaureate programs help provide Minnesota students with 
  1.22  world-class educational opportunity. 
  1.23     (b) Critical to schools' educational success is ongoing 
  1.24  advanced placement/international baccalaureate-approved teacher 
  1.25  training.  A secondary teacher assigned by a district to teach 
  2.1   an advanced placement or international baccalaureate course or 
  2.2   other interested educator may participate in a training program 
  2.3   offered by the college board or International Baccalaureate 
  2.4   North America, Inc.  The state may pay a portion of the tuition, 
  2.5   room, and board costs a teacher or other interested educator 
  2.6   incurs in participating in a training program.  The commissioner 
  2.7   shall determine application procedures and deadlines, and select 
  2.8   teachers and other interested educators to participate in the 
  2.9   training program.  The procedures determined by the commissioner 
  2.10  shall, to the extent possible, ensure that advanced placement 
  2.11  and international baccalaureate courses become available in all 
  2.12  parts of the state and that a variety of course offerings are 
  2.13  available in school districts.  This subdivision does not 
  2.14  prevent teacher or other interested educator participation in 
  2.15  training programs offered by the college board or International 
  2.16  Baccalaureate North America, Inc., when tuition is paid by a 
  2.17  source other than the state. 
  2.18     [EFFECTIVE DATE.] This section is effective July 1, 2001.  
  2.19     Sec. 2.  Minnesota Statutes 2000, section 120B.13, 
  2.20  subdivision 2, is amended to read: 
  2.21     Subd. 2.  [SUPPORT PROGRAMS.] (a) The commissioner shall 
  2.22  provide support programs during the school year for teachers who 
  2.23  attended the training programs and teachers experienced in 
  2.24  teaching advanced placement or international baccalaureate 
  2.25  courses.  The support programs shall provide teachers with 
  2.26  opportunities to share instructional ideas with other teachers.  
  2.27  The state may pay the costs of participating in the support 
  2.28  programs, including substitute teachers, if necessary, and 
  2.29  program affiliation costs. 
  2.30     (b) A teacher who teaches an advanced placement or 
  2.31  international baccalaureate course is eligible to receive a 
  2.32  stipend for each student in that teacher's course who receives a 
  2.33  three or higher on the advanced placement examination that 
  2.34  covers the subject matter of the course or a four or higher on 
  2.35  the international baccalaureate examination that covers the 
  2.36  subject matter of the course.  If a teacher who is eligible to 
  3.1   receive a stipend declines the stipend, the district employing 
  3.2   the teacher shall receive and, after consulting with the 
  3.3   teacher, use the stipend to benefit the advanced placement or 
  3.4   international baccalaureate students or program that generated 
  3.5   the stipend.  The commissioner shall determine the payment 
  3.6   process and the amount of the teacher stipend, consistent with 
  3.7   applicable appropriations provisions, for each student receiving 
  3.8   a qualifying score. 
  3.9      (c) A stipend awarded to a teacher under this subdivision 
  3.10  is not a mandatory subject of bargaining under chapter 179A or 
  3.11  any other law and shall not be a term or condition of 
  3.12  employment.  The amount of any award shall be final and shall 
  3.13  not be subject to review by an arbitrator through any grievance 
  3.14  or other process or by a court through any appeal process. 
  3.15     [EFFECTIVE DATE.] This section is effective July 1, 2001.  
  3.16     Sec. 3.  [APPROPRIATIONS.] 
  3.17     Subdivision 1.  [DEPARTMENT OF CHILDREN, FAMILIES, AND 
  3.18  LEARNING.] The sums indicated in this section are appropriated 
  3.19  from the general fund to the department of children, families, 
  3.20  and learning for the fiscal years designated. 
  3.21     Subd. 2.  [EXAMINATION FEES; TEACHER TRAINING AND SUPPORT 
  3.22  PROGRAMS.] (a) For students' advanced placement and 
  3.23  international baccalaureate examination fees under Minnesota 
  3.24  Statutes 2000, section 120B.13, subdivision 3, and the training 
  3.25  and related costs for teachers and other interested educators 
  3.26  under Minnesota Statutes 2000, section 120B.13, subdivisions 1 
  3.27  and 2: 
  3.28       $2,000,000     .....     2002 
  3.29       $2,000,000     .....     2003 
  3.30     Any funds unexpended in the first year do not cancel and 
  3.31  are available in the second year. 
  3.32     (b) The advanced placement program shall receive 75 percent 
  3.33  of the appropriation each year and the international 
  3.34  baccalaureate program shall receive 25 percent of the 
  3.35  appropriation each year.  The department, in consultation with 
  3.36  representatives of the advanced placement and international 
  4.1   baccalaureate programs selected by the advanced placement 
  4.2   advisory council and IBMN, respectively, shall determine the 
  4.3   amounts of the expenditures each year for examination fees and 
  4.4   training and support programs for each program. 
  4.5      [EFFECTIVE DATE.] This section is effective July 1, 2001.
